Yes, it's not about piracy. They don't count how many is pirating but how many that would buy if they sell it here. In business sense, how much profits can they make make if it is sold here. But with Malaysia small market, most probably they calculated that it is not worthy to set up a Xbox distribution network in this country.
So normally MNC will go with plan B, give a sole distribution right to a company here and this company will grow the network. MS doesn't need to take the risk of investment not bringing profit and the same time can have additional country that they supported. I'm sure a lot of company will jump in (pun intended) to be a sole distributor for Xbox games in Malaysia.
So why plan B still not implemented? My guess is probably issue of either: 1.) The T&C to be the sole distributor is too favoring to MS that no company willing to invest as they see the risk is too great. Or 2.) MS SG or MS HK is blocking from setting up distributor in Malaysia. As the game here are mostly imported from these 2 countries, setting up distributor here would means these parrel importer will not buy from them anymore, that means their balance sheet will look very bad.
