if they are not 'featured' in any official stock Note 2 ROMS, then by adding these into the ROMS... you get what i mean, right?
i mean... when we expand this further, we'll end up with people putting stuff like Asphalt, Final Fantasy, etc into their ROM -- maybe just because they like it.
no doubt these Note 3 features are 'made by Samsung', but technically, unless they said its OK (or by bundling it with Note 2), otherwise, it can be considered piracy, no?

About apps, if it is a paid app, xda will ban and remove the roms. If it is a free app no issues since you can also download it anyway.
On features, look at it this way. Everyone that is using the rom is already using a samsung and had technically bought the feature with the phone anyway.

But there are features/mods/apps taken from other phones like sony, htc, etc. So in a way we can say it is piracy. But the companies do not seem to be bothered as this had been going on for years. Probably cos,
1. Taking features/mods/apps from other devices is usually prone to some missing things/hardware that will make it not 100% functional
2. Its a kind of advertising for other manufacturers to lure future buyers.
3. Its just not worth it for them to pursue anything.
