Should I buy second hand phone to replace my XZU? or save money and temp use iPhone 3GS and wait till dec to buy Note 3?

Not sure if I can get back the phone because the sucker keep saying didn't stole my phone and he agree to meet my dad at monday.

But now, alot of real strong proof is killing him. Somemore got people saw him play my phone.
