Nowadays how many modded consoles are actually running homebrews only, mostly all are just for playing pirated games
maybe there are still few older original Xbox classic around, which many modded for XBMC purpose, but again it's rare

3DS with flashcart? definitely all are about piracy

so IMO, the ban should be across the board, sales of any type of flashcart (either new or old), and any type of modded consoles should be banned.
