Chronology of events leading to the tearing down of SW Big Rock sculpture. It lists out the SW JMB management process as had occured, for transparency in this matter. No opinion, implied or otherwise, is offered.

a. August 3rd, 2015 JMC meeting.
According to August 3rd 2015 official minutes of meeting,

"YTS presented the opinion on why the sculpture were to be removed"

" In conclusion, the Stone Sculpture will be removed based on the majority votes."

"YTS=Yin Ting Shin."
Unquote.

According to data published by management, YTS is the owner of unit B-03-1.
The minutes did not mention the existence of any proposer or seconder for the vote.

b. September 7th, 2015 JMC meeting.
Options and costs for removing the rock sculpture were first discussed. PMC to pick the contractor.

Next a letter from COB was presented. It essentially stated the following.

PMC to write to COB for clarification.

c. September 17th 2015.
PMC wrote to COB regarding JMC decision and sculpture not in building plans.

d. September 25, 2015.
Draft minutes of JMC September 2015 meeting were issued by PMC via email to JMC members.

e. October 2nd, 2015.
The following email reply was sent out by Richard at 11:09 AM to PMC management and all JMC members regarding draft minutes of September 7th, 2015 meeting.

In view of a written letter from COB on removal of The Rock sculpture, Martin has suggested that management seek clarification from COB on whether its letter is merely an advice which is up to JMC to accept or an opinion which JMB has to follow given that the sculpture is not in any SW plans available to management.

f. October 5th and 6th 2015.
Actual physical dismantling of The SW Big Rock sculpture.

g. October 12th, 2015 JMC meeting.

TODAY SW JMB management received a written reply from COB essentially saying : -

Richard officially disputed the accurateness of Sept 2015 JMC minutes of meeting. He was requested to put in writing the dispute.

PMC informed JMC The SW Rock Sculpture was dismantled already.

h. Oct. 18, 2015
Richard provided a written rebutter regarding the error in Sept. 2015 JMC meeting minutes to all JMC member and management.

h. Nov.16, 2015 JMC meeting.
PMC would not comment on the accurateness of Richard's rebutter by refering to voice recording.

Two JMC members suggested any unhappy party(ies) can sue JMB or bring the issue to the Tribunal. No proposal on this subject matter was accepted for voting.

Note:
1. Richard informed management and JMC members there was a mistake in draft minutes of meeting on the morning of October 2nd 2015. This is well before the dismantling of the sculpture on 5th and 6th October 2015.

2. The sculpture was dismantled before PMC received the written reply from COB. The letter did NOT withdraw its earlier view that an AGM or EGM vote is needed to dismantle the Rock sculpture.

3. The sculpture was dismantled before JMC has an opportunity to deliberate on COB's reply and whether to proceed with destruction in view of COB's letters.

4. In view of COB's letter, JMC did not at any time deliberated and voted on whether to proceed with removal of the sculpture.

5. COB official letter were totally omitted from the minutes of September 7, 2015 JMC meeting and draft minutes of October 12, 2015 JMC meeting.

SPS now indirectly holds the responsibility for the management of SW because its related company holds around 15% share unit of SW JMB. In an AGM this share unit number is often more than the share units of all the attendees summed up. During last AGM it exercised its full voting power to reduce JMC size to only 10. This means a quorum of only 5 is needed in an official JMC meeting. Last term the SPS rep only attended about half of almost every official meeting. And yet this is the same rep that holds the vote and exercised it to its full power. Many in current 4th term JMC, essentially determined by this rep, is in their third or fourth term! Good friends alone may not be best.

Insurance at RM500k+ premium is among the biggest contract. Last year, the JMC member who was in the sub committee to look into insurance tender is the sole proprietor of the insurance agency that was awarded the contract.

And look at the way/chronolgy of events on how the last term Jmc Chairman managed the tearing down of the rock scrupture - an aesthetic asset purposed built by developer. He is in the current term with the support of SPS rep. SPS top management needs to do something to correct this in order for SW to compete in this difficult environment. Assigning a rep who sets the managemet on auto cruise/status quo, especially for the commercial portion is not sufficient.

Three reasons were offered.
1. It blocked the view from block B.
2. It hindered human walking traffic.
3. It looked ugly.

Go on site to examine the leftover mark on the floor and you will see reason 1 & 2 is not fully valid. The Jmc member who suggested reason 3 withdrew her vote for dismantling the sculpture.
Not sure whether those who wanted to tear down the sculpture have anything to do with the way Management (as managed by PMC Property Services) even ignoring the official written view of COB to bring the issue to an AGM for a decision.

Removing an asset that that is part of overall assets that help to set SW apart from the rest of commercial centres in the market, is a step backward.

A last term JMC member proposed the number of Jmc members be reduced to 10 during last agm although there were 12 valid volunteers. And the result of the vote shows SPS rep endosed this proposal. So a lower quorum is now needed to pass proposals. Is this good for the management of SW?

Yesterday was another early sold out day for Nasi Kukus TTR @SW.

It has been consistently serving this single dish to about 100 guests and more during every working day lunch since its opening on 1st March 2016.

It is offering among the most delicious Nasi Kukus in Malaysia. And getting better and better with experience.

Another top recipe is COMING SOON to Nasi Kukus TTR @SW - from the Winner of The Star People's Food Award for the Best Rojak Buah in Klang Valley.

Opening hours would also soon be extended till about 10pm Mon to Sat.

Prediction of daily sales volume is thus critical. Volumes available are continually adjusted. Sold out situation would happen during any unanticipated increment in volume. For this reason, large party/seminar volume requires a day notice.

Nasi Kukus TTR @ Setia Walk is pleased to announce effective from Friday, 27 May 2016, it will be having much longer business operation hours of 12 noon to 10 pm, Mon to Sat. Close on Sunday and most public holidays.

It wish to extend its sincere apologies to many who fail to get to enjoy its delicious nasi kukus on the many days when its sales were much higher than anticipated. And this includes today.

Sincere apologies also to many who are unable to enjoy its nasi kukus due to its present short 12 to 3 pm business hours.

With the extended hours, it will anticipate additional volumes for each day.

Thank you all for the GREAT support. It will continue to ensure consistent quality all the time - super aromatic and tender chicken, delicious complementary daily fresh curry with refreshing crunchy pickled veges and fruits as well as outstanding savoury sambal belachan with steam rice - the ultimate make up of a super delicious nasi kukus. SP Setia indirectly owns SW Mall. This entittles it to about 15pct of total share units. Usually all the owners that turn up in an agm were much less than 15pct of total share units. This means no point voting. SPS one vote would overhelm all the other votes summed up whatever the issue. Last year SPS clearly voted to reduce the number of volunteered jmc members. Less people less noise. SPS is in full control of SW JMB. About RM25k per month is paid to 3 mgt staffs for marketing/promo. So why still such poor performance? Why is mgt not delivering what it promised in bnw? Why is JMB not doing anything to correct this course? SP Setia must hold major responsibility if Setia Walk contine to go downhill. A SPS rep in JMB who just show face for half of meetings time is just not good enough. SW need a more responsible and dedicated one.The success or failure of SW is partly in SP Setia's hand - to go in the right direction or otherwise. Conflict of interest is never good.
