3B. Fair Usage Policy
(a) The Fair Usage Policy sets out an acceptable level of conduct between ABN and its Subscribers using the HSIS. All HSIS Subscriber shall be responsible for the usage of the HSIS and how it affects other HSIS Subscribers.
(b) The Subscribers understands and acknowledges that certain software or applications which are used by some Subscribers to send and receive files containing very large amount of data (including without limitation traffic from peer-to-peer software or applications. These activities may cause network congestion and can negatively impact the speed at which other Subscribers can access the HSIS.
© ABN does not guarantee a service level and/or connectivity to users of peer-to-peer or file sharing software or application. ABN may seek to manage Subscribers using very high bandwidth by throttling their bandwidth to a much lower speed to ensure fairness to all Subscribers.
(d) Further ABN hereby states that ABN clearly prohibits the downloading of illegal content which amounts to an infringement of intellectual property rights or copyright and the rightful owner of the intellectual property rights or copyright may take measure to prosecute. Each individual download can be traced by the Subscriber’s IP address back to the Subscriber’s account with ABN. ABN hereby reserves its rights to release such Subscriber’s information pursuant to any infringement of intellectual property rights or copyrights if it is required to do so by any law, regulatory body or by a court of law
6. Minimum Subscription Period
Subscriber agrees to maintain and keep Subscriber’s account active for a minimum continuous period of:-
(a) 12 months in regards to CATV Services;
(b) 24 months in regards to the HSIS Services; or
© 24 months in regards to the bundled CATV and HSIS Services from the date of activation of the Services (collectively known as the “Initial Period”). In the event Subscriber terminates or deactivates the Services at any time prior to the expiry of the Initial Period for any reason whatsoever, including without limitation, by failing or refusing and/or neglecting to pay the Subscription Fees as and when due, ABN may charge on the Subscriber’s account of the sum of Ringgit Malaysia Five Hundred (RM500) for such early termination or deactivation (the “Initial Period Penalty”).
9. Personal Data
(a) Personal Data will be obtained from Subscriber at the time of subscription for the Services or as may be requested from Subscriber by ABN at any time thereafter or from existing Personal Data which had been collected by ABN previously.
(b) Subscriber hereby consent to the use, processing and/or providing of any and all of the Personal Data by ABN for the following purposes of
(i) providing the Services;
(ii) marketing any products or services of ABN, its affiliates and/or ABN’s business partners, including any promotional campaigns;
(iii) complying with any statutory or legal obligations and any applicable laws, rules, regulations, codes orders and/or directions issued from time to time by any bureau, statutory and/or regulatory body;
(iv) credit checking or for credit monitoring or record by third party;
(v) to process your payment transaction;
(vi) respond to your inquiries;
(vii) conduct internal activities;
(viii) market surveys and trend analysis;
(ix) to communicate with the Subscriber;
(x) any other activities which are ancillary to the Services; and/or
(x) other legitimate business activities of ABN;
© Subscriber also consent to the disclosure of any and all of the Personal Data to:-
(i) ABN’s affiliates;
(ii) any telecommunications provider in connection with the Services;
(iii) ABN’s agents, auditors and advisers and those of ABN’s affiliates;
(iv) any other parties which provides retail products and services (for the purposes of marketing activities);
(v) any organisation which provides credit checking services;
(vi) any entity or person, the disclosure to which is reasonably necessary or desirable for the provision of the Services; and
(vii) the transfer by ABN of the Personal Data to locations outside Malaysia for any of the purposes set out above.
(d) Subscriber may request for access to or correction of the Personal Data or for limiting the processing of the Personal Data at any time hereafter by submitting such request to ABN in writing to the “Personal Data Protection Officer” via ABN Cable Guy.
11. Suspension and Termination
(a) ABN shall have the right, in its sole discretion and without notice, to suspend or terminate Subscriber’s access to the Services if Subscriber breaches any of the representations and warranties made above or any other term of this Agreement or Subscriber fails to pay ABN and/ or its authorised agents for the Access Equipment purchased or use the Access Equipment in a manner not permitted by this Agreement or determined inappropriate by ABN.
(b) Subject to Clause 6, Subscriber may suspend or terminate the Services by giving a minimum of one (1) months’ notice. If the Services are suspended or terminated either by Subscriber or by ABN, Subscriber shall remain liable to pay the full Subscription Fee for the entire billing month in which the suspension or termination occurred, all amounts due from Subscriber prior to such suspension or termination together with the Initial Period Penalty in the event the suspension or termination is prior to the expiry of the Initial Period as provided in Clause 6. For reconnection of the Services, Subscriber will be charged an administrative fee as may be advised by ABN from time to time. All amounts due must be settled before the Services can be reconnected.
© Notwithstanding the above, ABN may in its sole discretion and without any liability to Subscriber suspend or terminate Subscriber’s access to the Services at any time for any reason whatsoever. If Subscriber has not breached this Agreement and ABN suspends or terminates Subscriber’s access to the Services, Subscriber will be responsible only for payment of Subscription Fees up to the date of such suspension or termination and any amounts due prior to such date.
(d) This Agreement shall automatically terminate in the event the Access Equipment, including hardware and software used by ABN in the transmission of its Services, become affected in their performance and/or functionality so as to render it impossible for ABN to continue to provide the Services. In such event the sole extent of ABN liability shall be the refund of any advance Subscription Fees paid by Subscriber for the duration of the interruption prior to termination.
