 Deposit for Bulk Meter upon Vacant Possession, Deposit for Bulk Meter

Hi All,

I have some concerns regarding my new condo and hope to get some advice on what to do.

I purchased a condominium last year.
Last week, I received the Notice of Delivery of Vacant Possession from the developer.

This notice came with the amount payable to the developer with regards to the vacant possession.

Apart from Quit Rent, Insurance, Stamp Duty (TNB), Maintenance Charges (4 months) & Sinking Fund (4 months) charges, the amount payable includes the following :-

Water Deposits for :-
i) The Property RM 100.00
ii) BULK METER RM 166.40

Electricity Deposits for :-
i) The Property RM 400.00
ii) BULK METER RM 1,177.27


My concern is regarding the deposits for the Bulk Meter.
The developer explained that a huge amount was paid to TNB & Syabas for setting up the infrastructure.
Now, this cost is distributed among all the property owners.

When I contacted TNB regarding the amount RM 1,177.27, the person from TNB advised me to get further clarification from the developer.
She mentioned that the amount of RM 1,177.27 is a bit strange.

Therefore, I have the following queries :-

1) Is it normal for the developer to charge deposits for the Bulk Meter to the property owner upon vacant possession?

2) Since this is described as deposit, how will I get the refund? The developer said that I will be able to reclaim this money by charging the next owner, in the event of selling my property. I think this is an abnormal process to get back a refund of a deposit.

3) Can the developer refuse to handover my property to me, if I settle other charges except the deposits for the Water & Electricity Bulk Meter?

4) Can the developer charge late payment interest on the outstanding deposits for the Water & Electricity Bulk Meter? Based on the letter from the developer, the amount payable will be due on this Thur 24-Jan-2013, as I am given 14 days to settle the outstanding amount.

5) Who can I contact to get further clarification or help with regards to this matter?

deposit and contribution cost is two different criteria.

U only honor payments what ever stated in SPA, not any extraordinary charges.

Hi peri peri,

Thanks for your reply.

I've checked with my friends regarding this issue.
So far, none of them had been billed bulk meter deposit during vacant possession of their condos.

My friend asked me to check this matter with my lawyer who was responsible for the SPA.

There is no longer bulk water meter. The current law in play requires ALL bulk water meter usage to switch to individual water meter.

You may want to start a new thread to discuss on your issues.

Also, your questions/issues (or TS) you encountered can be addressed if you look into the contents of your SPA.

Wirte back to the developer owner shouldnt be billed directly like this...

Either developer absorb the cost or ask the management company of ur condo absorb this cost thru their monthly maintenance bill

Depends on project, some still using bulk but not for electricity. Becauze contribution cost bear by developer between bulk and individual is very much different.

Is this thread still alive

I am currently in a dispute after buying a subsale property which i am living in now. my spa did not mentioned of any bulk meter charges, only individual meters.

After 8 month of staying in the said property, JMB issued a bill asking me to pay for the Bulk and individual water meter and Bulk TNB Meter. This kind of raised some questions

1. Why do i have to pay individual water meter deposit to JMB. If i am not mistaken, if there is individual water meter, my bill should be from SYABAS, not JMB and JMB cannot cut water supply which they did.

so for apartment. Developer will help us to register for TNB and SYABAS? meaning that we will get water and power supply instantly upon VP?

Actually this bulk meter is for common area water and electricity. It is an advance collection from the owner as when developer wanna handover to jmb after developer period. Developer will use this money to apply a new bulk meter from syabas and tnb.
So if you wanna subsales your unit basically can recover from your buyer.
There is a clause in spa stating purchaser should bear the deposit of installation water and electricity

My rumawip is expected to VP this year. Paid RM644 for individual meter deposit for SYABAS and TNB.

Yes, individual meter.

Why bulk meter ? Who want to pay more for water?

Since the day I converted to individual meter, the water always always free of charge. RM 0.00
