And to top it off, they weren't exactly harassing. It was a mutual agreement between OEMs and Microsoft. Even the amount (per device sold) was negotiable, unlike Apple, bringing everyone to court. If these OEMs don't think Microsoft has the necessary patents, they can always refuse to pay, but in reality, Microsoft does hold a few key patents that Android infringes upon, in particular, patents related to FAT storage systems.
Microsoft can't go after Google because Google does not sell / make profit from Androids, they make profit off ads generated by Androids. Way to hide behind the OEMs. When Apple sued HTC over Android patents, where was Google? When Apple sued Samsung over Android patents, where was Google?
On contrary, Microsoft and Apple has cross-licensing / patents and this would stop Apple from going after any OEMs that produce WP. Anyone who produces a WP is pretty much covered from lawsuits.
That pretty much sums up the "do no evil" empire.
