I have one 3rd party xbox 360 slim hardisk 250gb (used on mod xbox before), and im planning to get original xbox 4gb and use back my 250gb hardisk on it.
i already delete all files on that hardisk. Will i get banned if im using it?

Dude you will not get banned by m$ for hdd. I had it 2yrs ago, and i had it now, you won't get banned just because of it. As long as you do not need to pry open the xbox to replace it & as long as PS3 allowed any harddisk.

Try to format the HDD on an unmodded console will do as modded xbox360 can use any HDD but unmodded console need to be properly partitioned & Security Sector installed.
