**The issue of the stupid SULUK Sultan claiming rights over Sabah is played again to strengthen BN/UMNO controls in SABAH. By Law, SULU cannot claim Sabah because before Spain left Philipines, the Spanish have signed The Madrid Protocol of 1885. It is an agreement between Great Britain, Germany and Spain to recognize the sovereignty of Spain over the Sulu Archipelago as well as the limit of Spanish influence in the region. Under the agreement, Spain relinquishes all claim to Borneo.***

Furthermore during the Madrid Protocol 1885, Sultan Badarud-Din II
(1881-1884) of Sulu died without a male heir.

Article III of that Protocol reads:- "The Spanish Government renounces, as far as regards the British Government, all claims of sovereignty over the territories of the Continent of Borneo, which belong, or which have been belonged in the past to the Sultan of Sulu (Jolo), and which comprise the neighbouring islands of Balambangan, banguey and Malawali, as well as all those comprised within a zone of three maritime leagues from the coast, and which form part of the territories administered by a company styled the British North Borneo Company". Under that Protocol Sultan of Sulu remained his sovereignty rights over the territory of North Borneo.

In 1877 29th December, Gustavus Von Overbeck was crowned Maharajah of Sabah, by Sultan Abdul Mumin Ebn Marhoum Maulana Abdul Wahab who served as the Sultan of Brunei. North Borneo was a land unexplored at that time. And rights be given and both leased to Von Overbeck. And this was a permanent deal. Although Sulu Sultan claims ownership over northen part of Sabah, but since he was the younger brother of the Sultan Brunei, therefore the power to transfer bested in Brunei and not Sulu.
