You dont need to buy original or OEM, just buy newly Western Digital Blue 320GB sata. Follow the firmware upgrade tutorial in Google and that's it. I've done with mine. But if you ask whether it's legit or not I'm not sure. However, you would NOT be banned in Xbox LIVE.

I don't have original nor 3rd party Xbox HDD. I was using Western Digital Blue 250GB, did a HDD firmware flash. Insert it in original Xbox (unmodded), play and signed in to Xbox Live without any issue.
3rd party HDD doesn't make you to be banned from LIVE

also my latest survey on WD 3200BEVS drives are now RM165. whole sets with casings might cost you RM185 + several hours of trial/downloads/messing with tools to mod the drive's Security Sector/Partition 2.

I ended up brought 250GB OEM HDD from bukanboss by paying RM200 and recover the partition 2 myself as 250GB is more than enough for me to download anything I want from XBOX LIVE.  thumbup.gif

As long as one never meddle with the harddisk files they will never get banned due to Harddisk.

TOS states only user who modded the console & software integrity will get banned. Obviously is more to protect XBOX LIVE users from cheats and prevent you from playing pirated copies is just part of the package  whistling.gif

totally agreed..

recently i moved from original to modded console. as i brought the 250GB from original console. i don't feel that there will be of use of it anymore (except than saving the gamestats) which makes the HDD actually useless now, because I can simply hook in 1TB HDD over the USB ports with modded console.

anyway, what does it means by "....several hours of trial/downloads/messing with tools to mod the drive's Security Sector/Partition 2"?
I found this tool called HDD Hckr v1.3 and it's as easy as counting 1,2,3. After performed that, I can see my HDD is marked with "Microsoft" logo, and just need to format that from Xbox itself.

Well let's put it like this, If I were Microsoft, I don't mind my users buying 3rd party HDD. Because as the more space they have, they will likely to download and buy products from Xbox Live, which becomes a huge plus point to MS.
