Item being sold/bought: Maxis mobile broadband (MIFI Modem and Simcard)

Date of transaction: 22 September 2012

Amount of money involved: RM950.00

Details of the complaint :

The main reason I'm posting here is due to the long delay of parcel still not received by me and the twist of facts by the seller. I'm going to post the timeline of what had happened in below in order to give a brief idea to all of you, please look closely on the timing.

Timeline:
Sep 22 (Saturday) - Paid a lump sum of RM950 to the seller by following his instructions

Sep 27 (Thursday) - Received call from Maxis for customer verification purpose. I am not sure if it was a GENUINE call or not. I still have my call history and the phone number was 012-5019143. However, I've sent a PM to the seller to inform him that I have received a verification call from Maxis. The seller told me that at this point of time, I should wait for the simcard to be activated and sent to me. Right after that, he sent a registration form and requested me to email the form back to him after completing the required details on the form.

Sep 28 (Friday) - I have completed the registration form and sent that form to his email. By the way, somehow I felt curious as to why I received the verification call from Maxis eventhough I have not yet sent the completed registration form to the seller. Is this in a correct order, received call then send the registration form later?

Oct 6 (Saturday) - Sent a PM to the seller asking on the status as totally no updates or news from the seller to tell what is going on. Seller replied and informed that Maxis will update him on Oct 8 (Monday).

Oct 10 (Wednesday) - I knew that the seller informed me that Maxis will update him on Oct 8 (Monday), however there is no news/updates from the seller until Oct 10 (Wednesday). I chose to wait until Oct 10 (Wednesday) to give some time to the seller as he might be busy or Maxis busy. I then sent a PM again to the seller to ask on the status, at this point of time I'm starting to get a little frustrated.

Oct 11 (Thursday) - Finally the seller replied my PM, however his reply was strange. In his reply, he asked me whether I have received the verification call from Maxis. What? Why ask me again on this? I have already told him that I already received such call since Sep 27. I told him to refer to my PM on Sep 27 on the Maxis call. Next, he said my postage is under transition and was posted since Oct 6 (Saturday).

Oct 15 (Monday) - Still not yet received the parcel ever since from Oct 6, 1 week has passed. I sent PM to the seller to ask how was it sent out and he told me that it was sent through Post Express. He offered to try to find the tracking number, and he even reconfirmed with me that the parcel was already sent out a week ago, and told me that I should have received it at this point of time.

Oct 16 (Tuesday) - A day has passed, sent a PM to seller on whether he managed to find the tracking number.

Oct 17 (Wednesday) - He then replied that he is not yet been able to get the tracking number. Besides that, he listed out my exact address that the parcel was posted out to, and also gave me the new phone number registered under my new simcard which was under the broadband simcard. I told him to follow up on this matter, but instead he sent a PM to me asking have i still not received the mail, and if not, he told me only got 1 way which was asking me to go Maxis center to get a simcard replacement. This suggestion is useless as I am still waiting to receive the modem. Although I can always get a simcard replacement, how am I going to use it without the modem?

Oct 18 (Thursday) - Postage since Oct 6, but still not yet received by me. Seller told me that all the parcel from a week ago got LOST during transit. Told me some have received, some did not received.

Oct 21 (Sunday) - Sent another PM to the seller on whether any action has been taken by him. Not long after, he told me that he has taken action and a NEW modem is going to be posted to me. In addition, he still asked me whether I am sure or not that I didn't received the old modem and simcard at my address. Pointless question if you get what I meant. If I have the tracking number, for sure I will do my part and investigate with Post Office on the status. He even told me that I NEED to go to Maxis center to get the simcard replacement. Same question asked again..Then, I told him that since a NEW modem is going to be posted to me, why not include the simcard? Why must tell me to get a simcard replacement from Maxis center? Why must I do that? If the seller insist to do so, ok then I'll go get a simcard replacement. But who is going to pay for the replacement? I have not asked the seller if he is going to pay, but I have found out that one of his customer has no choice to get the simcard replacement (instructed by the seller) and in the end the customer was the person who bear the cost. The seller sent a PM to me that he will try to get the tracking number and inform me by the next day Oct 22 (Monday).

Oct 22 (Monday) - At this point of time, I should expect some response from the seller. But none and I decided not to PM on this day and only to voice out on the next day Oct 23 (Tuesday).

Oct 23 (Tuesday) - Still no news from the seller after i sent a PM asking on status. I knew that he was online but no response from him. My PM was sent on afternoon, and his last active time was on the same day 6:08PM.

Oct 24 (Today) - Finally got a response from him. Please refer below for the response given by him. I haven't replied to him yet, but anyway please refer to my response in blue colour below.

you should've PM'ed me and I would've sent you the tracking number and if you wanted the refund for modem you could've asked me,

You tell me to PM, and yes I did. But where is your response? Some more telling me that you will send the tracking number? U sure or not? Now also have not given the tracking number. Where is your cooperation? I am very willing to do my part too but I am unable to do so as I really need the tracking number to investigate. From my past trade experiences, there was once a parcel delayed quite long, and decided to investigate with post office as I have the tracking number. If you can't do your part well, then throw all the hassles to me then by giving me the details of the Maxis contact person so that I can deal directly without troubling you. I am more than willing to do that. Refund for modem? You're saying that I could have asked you? Before you ask me that question, you should questioned yourself on why you have not given me the option to refund since you know that I am a frustrated customer? You are not professional as you did not offer refund at the first place, I'm sure some of your customers are facing the same problem as me. A good example was when I've joined the bulk purchase for the HTC One X casing accessory organised by someone in LYN forum. That delay took very long and everybody was waiting, and in the end the organiser decided to cancel the bulk purchase and offer to refund to his respective customers. Ok then, from what you've said, it seems to me that you could offer a refund right? Please refund the modem price to me so that I could use that refunded money to buy another modem by myself. No troubles then as simcard replacement is easy right..Problem solved.

giving tracking number doesn't mean you will receive the item, it is posted to you and even without tracking number you will receive the sim and modem

I have waited so long and you want me to wait the parcel to be sent to my address blindly? You try lah! It is way off target. That is why I insisted to get the tracking number to investigate.

I suspect you have the sim already with you , it does looks like that to me , why don't you just go to maxis center and get the sim at least so I can convince maxis that your postage is lost, they are saying it is not lost and you are saying it is lost

The only thing that I always said is I HAVE NOT RECEIVED THE ITEM, i did not say lost. Try to differentiate that statement. I'm done now.
UPDATE as at 31/10/2012 - Simcard replacement had been done through Maxis center and modem cost refunded. Case SOLVED.

Hahaz he did ask me did I got the phone call when im waiting after 2 long weeks ...and telling me the simcard at his place instea of at Maxis centre...After 1 week he said the simcard at maxis place. ...and after that saying its lost. ..now I have to pay rm25 for a new sim replacement

bro, from your explanation, very obvious those are twist of facts..However, I'm not blaming him as SCAMMER, just that the type of responsibility is not there and not expected by us..I'm raising my dissatisfaction only

Please don't do such accusations towards the seller. I have trust on him but the way the trade has been done is off my expectation as a customer. Once again, please be cautious before concluding that it is a scam as other unaware customers may change their perception towards the seller that the trade was a scam. His trade history is well established and we do not want to spoil such reputation by saying it is a scam.

I did told you in my PM that the reg form will be sent after bank in and sorry forgot to tell after verification, I don't think this as a matter of thinking me as a dispute or scammer

It is sometimes hard to keep track of every person if they received the call or not, I don't think it is strange to ask you again to reconfirm if you have received the call or not.

And when you told me that you have received their verification call problem solved, I checked you have received their call, verified with maxis if your stuff posted, they answered positive it is posted already

I asked you to get the sim replacement first, and I will handle the modem replacement for you, is it too hard to go to maxis center to get the sim replacement the same day get the sim at least

(to all parties that thinks this is a scam, please do note that his new activated phone number is 60124402936 and he can go anytime to maxis and get the sim replaced)

The sim replacement by me, is really hard, there were several cases of parcel lost (you know how Post Malaysia works) getting the sim replacement is really hard, but if you wanted me to do that wouldn't be a problem, I could do it for you but you will have to wait long time for that

why you didn't asked me and thought everything by yourself ?

If you asked me that who will bear the cost for the sim replacement, I could help you and pay the RM25 replacement fees , I will always be good with people who is good with me

bro some times , I am showing up online but not online all the times, yesterday was working on different customer case , who was pushing me to the edge and trying to get his registration through and was not able to make it online the whole day, which I am sorry about.

bro only a bit delay in the reply , I stated above that I was working really hard on different customer case, he pushed me to the edge, was trying to resolve that and was not able to reply to you in timely manner but that doesn't mean that you have to open a dispute thread on me ?

It is a normal question to ask, you told me you didn't received the sim, nor the modem , the address is also correct,

I was investigating the tracking number for you, but bro you have to be patient in this case , and why don't you just get this over with , go to maxis center get the sim replaced, I send you a new modem , problem solved ?

Both are the same thing la, you didn't received it = means lost or you received it but not willing to take responsibility

why don't you just go and get the sim replaced, is it too much to ask ?

if you want RM25 sim replacement cost, no problem also for me, I will bank in that for you

and now I am offering a solution

go to any maxis center , get the sim replaced , I pay the cost - RM25

and wait for the modem replacement free of cost

2nd solution

go to maxis center , get the sim replaced

I refund the RM25 replacement cost and the modem cost = RM950 - RM300 = RM650 to you

I am the one fully cooperating with you , even when the postage lost, bro have you ever heard of any other seller replacing the modem even when it is not his fault

His sim is already activated, this can't be a scam, postage is on buyers risk as always, it can get lost , but even though I was willing to help him out , get sim replaced asap and get him the modem replaced also and free of cost some more

Post Express postages tend to get lost a lot, just now have finally stopped using it

I appreciate that you are here to discuss and solve the problem openly in this thread. I would like to clarify one thing, I have trust upon you and I never ever label you or your trade as SCAM. I am very sensitive towards using such word, as a simple word as that is enough to be destructive towards anyone who is accused with. I'm saying this just to be clear to everyone, as there are some people who posted straight away jumping into conclusion and deeming it as scam which we do not like to be associated with it.

On the other hand, you are suspecting me that I have already received the simcard, but before having such suspicion towards me, the best solution is to get the tracking number and find out what had gone wrong. But now both of us do not have the tracking number, therefore I don't think it's right to directly have a suspicion towards me, this is jumping into conclusion without valid facts. You suspected me of lying that I have not received, but I can also suspect you that the parcel was not sent out. However, did i directly mention and suspect you of scam? NO! What I am trying to point out in this dispute thread is the way how the trade is handled, not about SCAM. I acknowledged that I myself may be impatient in certain times due to deep frustration, however it is important that traders are capable of handling such behaviours as other people out there has different traits of personality, which means they might deal in much different way. Ok, now you have explained that you have worked really hard to tackle on different customer case in which you have difficulty in coping up with other customers demands. I then now understand your difficult situation, but I still think that it will better for you to inform us that you are really on bad times in coping up such challenges, so that we understand and won't keep pushing you. If you are busy, just say it out, don't let the others guessing what are you up to. I'm saying this because your other customers are also currently facing the same delay. A lot of them posted on your selling thread, and there was no clarification from you to inform us on your difficulties. I hope you would be able to consider and improve this matter.

Another point I would like to point out, you shouldn't just push your customers to directly go Maxis center to request simcard replacement. For other customers who only applied the simcard package without phone/modem, it is more appropriate for them to do so as simcard replacement is easy and can be done instantly. By doing so, they can directly utilise the simcard. For my case, I don't think it is very important to get the simcard replacement. I can easily get the simcard replacement, but I won't be able to utilise straight away. I need the modem that was included in the plan that I applied. The priority now is the modem, as once I have received the modem, the simcard can be obtained in a very short time through replacement. Without the modem, the simcard is not my priority. About the RM25 replacement cost, I am raising this matter as one your customer is saddened by the fact that he had to bear the cost. This dispute thread is not for me alone, it means a lot to other customers too which I am helping them to raise their concerns. And I just received PM from that customer informing that he has received a PM from you just now offering to refund the RM25. I'm not sure what had gone wrong in the past between you and him. Why is it only now then the offer of refund can be made to him after this thread has been opened? But anyway, it is good now that you are offering a solution to us (not me alone), or else troubles will get deeper as time flies.

By looking at the solutions that you offer to me, why are you suddenly unable to refund me the full amount as what you told me in PM few moments ago? Please let me know on this.

and all I am asking you to go and get the sim replaced, the modem leave it to me to get the modem replacement posted to you, when I told you that I have arranged the modem replacement for you , then also why did you needed to post negative feedback or post a dispute thread against me, it is so wrong, just ask me via PM and that time I was not online when you sent me the PM, around several hours only I was away from lowyat and when I got back I replied to you the soonest I could but you didn't waited for my reply at all and when I offered solution via PM , you have ignored that

Since you are unable to provide the full refund, I have now decided to solve this dispute once and for all by having you do your part in refunding the modem price to me and me visiting Maxis center to get a simcard replacement. You are now still retaining your deal with me instead of fully losing it for full refund. Once you have refunded the modem price of RM650.00 to me, I'll use that money to purchase a modem by my own and get that simcard replacement. If you are agreeable with it, please respond on this thread. Don't offer me some funny refund options in PM. smile.gif

1. If you don't have an all-in-one, invest RM300 something on it. If you already have it, start utilize it to the max.

This will help you greatly on the paperwork. Man, you know how I did business with you. For all I care in the world, unless you have the papers all you said to me is bull. Whatever papers related to whatever business you are doing right now, keep at least a copy of them. You gave me excuses you don't keep papers because of safety/security/privacy reasons. F*** that. At least until you and I completed our deal, you better keep your paperwork top notch.

No action talk only is sorely hated.

I'll ask you for stamps, prints or forms to show me that you do your part of our deal. You already submitted my application to *****? Then show me *****'s stamp. Blanking certain part of my application is ok as long as you can show me the paper. Giving me a tracking no. is not enough. I want to see the picture of that number on my package. You already sent my package? Then show me a picture showing my address on PosLaju slip or whatever, together with Pos' computer prints. An AIO can help you with all these.

Keep the paperwork top notch.

2. Put some effort in your story, instead of feeding crap. You said ***** called me for verification, then show me the proof. You said you pushed ***** to process my application faster, then explain to me 'how you push'. You said you sent my package already, then give me the tracking number, tell me what time you sent, what the address you put on my package, from where you sent. You said ***** works slow, then explain to me why slow, how slow, and what you did about it?

Show some effort in your story.

Because I paid what you asked. And to shut me up.

Initially I wanted to tiow you in this dispute thread, but then you delivered what you promised, and I already got what I want from you. I'm in a better state of mind compared to when we are in business. So I toned my post down and give you some friendly suggestions instead.

Very bad follow up and follow thru ( should be seller chasing buyer faster close deal)
If use pos express its very risky should provide the tracking code but lost without a tracking code is indeed suspicious. Come on item RM950 but use RM3 to deliver without tracking code?

The tier is

Maxis > < seller < buyer

so in the case is more like MAXIS / SELLER / BUYER

since this is a corporate plan, it is hard for someone like me (a student) to register to this plan. Well what I must say, I have to take the risk to buy it. Even I have to wait about 1 month, now receive the sim card dy, but still not registered. I have already issued this problem to tashfinsheikh, and he will take action. And I look further for his responsibility and efficiency.

bro i also using corporate plan (20 lines) . She personally delivery the simcut to me and also the free phone after maxis approved in 5 days. Since u mention corperate plan then confirm is agent/seller problem.

The corporate agent that do for me i dont even need to do anything alli need is tell her she will check. If you need i can introduce you to her quite efficient

LEVIATHAN, thank you for voicing out the things that had went wrong between you and the seller. I have to ask one thing as this had slipped out of my mind previously, do I need the paperworks if i go to Maxis center to get the simcard replacement?

On the other hand, I would like to inform that I have received the RM650.00 (refund of the modem price) yesterday in my bank account, should be from the seller but he did not informed me on the successful transfer of funds. Lack of communication again here. Now what is left to settle my case is the simcard replacement. I am not sure if I need the seller's paperworks in order for me to deal with Maxis on the simcard replacement, therefore I need clarification on this matter. FYI, I will be going to overseas and will be back on 31/10/2012 (Wednesday). I can only go to Maxis center on next Wednesday.

Update: I've just checked my email. Seller has sent an email (Today, 1:21PM) to me to inform on the refund of RM650.00.
