it is simple.When you bank in money to someone's account (even by mistake), the person has the rights not to refund it. This was based on what I got to know since I used to work in a bank.
Now, let's say if you make a police report and the accused is caught, the bank however has no rights to mess with the guy's account unless the court gains an injunction to do so (his account will be confiscated/freeze). If he has already drawn out the cash, then you can't do anything. But that does not mean he is a freeman.
