I m more of a buyer myself in LYN than a seller but I truly believe u should NOT bother too much about this issue. As buyers, most serious buyers if not all should know what deposits are not refundable. Or else, what is the point of a deposit anyways if buyers can order a unit and simply back out when they want? Might as well not have the process of a deposit. While it would be advisable for sellers to state that deposits are not refundable although I personally feel that's like stating that the sun rises in the East but it is not a rule or a must. Buyers are the ones parting with their money and as such, it should be in their best interest to enquire all about where and what their money is for. In the end, I will not in any way fault the seller as it was definitely a "willing buyer, willing seller" deal. It is now in the seller's hands to decide if he wants to refund the deposit or not. If ever he does, it would b from good will and an act of gentlemanliness and not through force. In this particular cas though, I honestly think the seller should give refund a skip. The buyer is clearly unclear with the concept of sales and also unfornately acting very childishly and forcefully when in truth, he should b apologising and requesting politely for a remedy to the matter. In the end, if u think about it, TS, u initially wanted to spend ur own money buying the hand phone. Now in essence, u only spend rm100 for it as the rest is paid by ur loving gf. In the end, u don't lose anything. |

This is just a bad luck for ts. Deposit is non refundable in my opinion because deposit indirectly means I put my cash to reserve that item. What if everyone reserve around and cancel, ask for refund? Cheer up dude.

lhongwuh had done it professionally to deal this matter with offering ts to make other item purchases,but TS doesnt want to accept the offer.
TS are buying a phone.not car.u cannot apply car sales rules on this about the refundable deposit.then why dont the deposit for buy a house,deposit to buy a gold necklace which is forfeited if the buyer cancel the deal.each item have their purchasing procedure.unfortunately the car rules cannot apply on this,as the item is a gadget.not vehicle. Customers Always Right(Hak Pengguna) is to protect buyer from get cheated or conned.not for suka-suka cancel order.from what i c,is the seller get unwanted deal process by the childishly buyer. Just a dime from me.peace guys.... |
