Judging from the comment on the last 2-3 pages or so, seems that everyone has given up on Genneva and proceed to some other discussion laugh.gif

Back to Genneva..... thumbup.gif

I read in the newspaper today that some customers and agents are claiming Genneva is a legitimate business and asking BNM to allow the company to re-open. Openly declaring this, they effectively are losing all together their legal recourse against the directors of the company for negligence in management of company's business which caused financial lost to the stakeholders and customers

So, to those customers and agents who are still in support of the Company, do think it over before taking sides. Which action is better ?

1. Support company ? hoping pressure from the 6000 customers and agents will lead BNM to declare Genneva is all well ?
2. Get together and initiate a class action to sue the people behind the company for their negligence and/or mismanagement of assets ? Even possibility of defrauding customers ?

BNM will not budge. That is a foregone conclusion. Hence, fat hope on option 1.

Option 2 has a better chance (even higher chance if the boss are very wealthy) given the current circumstances. It would be in the better interest of the customers and agents to get their acts together. Argue and present facts of the business. If there are some "upper" management who were previously involved in decision making, and are now willing to give some insider information, that will certainly make your case a lot stronger.

It is not a time to get emotional. You all got to manage the crisis and find the best course of action to redeem the money rightfully yours

For those pro genneva people, please go convince Bank Negara. Your arguments are same old stories already presented many many times here. Nobody is going to believe you except those diehard customers and agents.

For those against genneva people, we already know it is not viable. And those pro genneva people are not going to believe you no matter what you say

Whether it is a scam or not, we need to just wait 14 days and bank negara will announce it. From genneva accounting records, if there are no records of investment or business that generate enough profits to pay hibah, then bank negara will confirm to the customers the company is a ponzi scam. Now it is crucial for the Datuk bosses to convince bank negara they are legit. Otherwise, bye bye genneva

The Genneva Version 1 is confirmed contravene Bafia Act, so the company is shut down. The company is gone case. The on-going court case is about those Datuk bosses fighting for freedom and avoid life behind bars. Not about the company

Genneva Version 2 ? Genneva is doomed either way.

1. If the Datuk bosses can show BNM they actually have a fantastic business which can afford to pay the 24% hibah --> hey you are taking illegal deposit in an investment scheme --> contravene bafia act

2. If the Datuk bosses cannot show BNM they have a fantastic business --> hey you are operating a ponzi scheme

I did a ROC search a few months back. Spent RM30 to do company search on Genneva Sdn Bhd and Genneva Malaysia Sdn Bhd biggrin.gif

Genneva is a private exempt company. So, under Companies Act, they can opt to leave their audited accounts out when they submit their annual returns. To be fair, we cannot say Genneva "fail to submit" audited accounts. If they choose not to submit accounts, it is permitted by the Company's Act

Also, they have always claim that they are not an investment company. They claim that are pure gold trading company. So their operation is not under the purview of BNM. But I have never heard gold trading company like Poh Kong, Habib etc pay hibah, or charge 25-30% higher and give you back in discount laugh.gif

There are many stuff brought up in the last few days which we have already "discussed" with the pro-genneva camp in the last 60-70 pages. Maybe in your free time, you want to browse through the pages to have a better understanding ? thumbup.gif

Yes, they still need to do auditing for their shareholders, directors and tax returns. Apparently they did not

But for the public, they do not need to attach the audited accounts with their annual return and provide the financial info to ROC (ie make public) where the public can just pay RM15 and get hold of the information

We were talking about financial accounts here, so that we can find out how much is their profit, and whether the profit is enough to sustain the hibah. Other info on the annual returns is not much of use to ascertain whether it is a ponzi scheme or not

Yes, ISO companies do require to pre-lim their suppliers. I have a few customers who require my company to submit details to them in order to be their supplier

Yes, audited accounts need to be prepared. If non-exempt private company, have to lodged together with annual return

But Genneva is exempt private company, so they can just submit annual return + certificate in lieu. No need to file the audited accounts.

Therefore under the law, they can choose to hide their financial information. Nobody knows the financial numbers other than the shareholders and directors.

Of course, they need to submit tax returns with audited accounts to the IRD as well. But they can choose not to submit so they can continue to hide their secrets.

Hence, nobody can tell 100% whether the company is a ponzi or not, unless the authority raid the company and look at the accounts and see if there is any legitimate business to support payment of hibah.

The auditors' job is to give an opinion on the company account. Whether it can meet liability or not, they will still sign the report. Their duty is to give an opinion on the company's financials to the shareholders

If the company has no going concern issue, then a normal unqualified report is issued. If the company cannot meet its liability, ie company is insolvent, then auditor will qualify the report. They will still sign the report, but qualify the report with additional paragraphs highlighting the issue to the shareholders

No I am not an accountant. But for the past 20+ years, I have signed off my companies' audited accounts each year. So, I learnt all these from my accountant, argued with the auditors on why they want to qualify my report etc. So I am very familiar with what the auditors want tongue.gif

Would she and others have lost heir investments had BNM not raided and froze everything? Genneva v. 2 would have learnt after all they are the same people(?) But I can't be sure though. I know of some of these companies took great pains to comply with whatever laws, and conditions set by govt agencies like SSM and BNM, liasing with them, yet are still raided. You just wonder if it is political or more than just "protecting consumers"!

The ultimate losers are the ordinary folks[cool.gif. These are the people who try to make extra money legally through gold trading when opportunities are closing at every turn if you are not well-connected. And the well-connected investors probably got early warning before the raid! IF BNM/GOVT IS HONEST ABOUT "PROTECTING CONSUMERS" THEN BNM SHOULD QUICKLY SEPARATE OUT WHAT ASSETS BELONG TO THESE COMPANIES AND WHAT BELONG TO THE BUYERS AND RETURN THE BUYERS' INVESTMENTS AND ONLY FREEZE COMPANY ASSETS. But then that is like "kucing bertanduk" lah! So again the big losers are the ordinary rakyat....as usual! My sympathy to them. If they are holding the gold, my advice to them is not to sell them to quickly because the price of gold is expected to appreciate significantly in the next few years.

Bro, you are absolutely right. The aunties and uncles were the real victims. Now that BNM has raided. The ball is in their courts. They will need to prove that Genneva is a ponzi scheme, or they have contravened the law. Pressure should be put to them to speed up their investigation and prove to the victims who is the real culprits

If they take any longer, untoward incidents may happen. I can imagine some of the aunties and uncles' life time savings are on the line. So, we are talking about human lifes here if BNM still delays.

Hope BNM can gather enough evidence soon and prosecute the real culprits thumbup.gif

Yes the Con-Sultans are an integral part of the scheme. They should be accountable for at least 50% (if not more) of the responsibility. Without them, the company could not have grown into the size today. I am sure many aunties and uncles fall for the scheme due mainly to agents' sweet words, not the company's black and white agreement. Just imagine if Genneva calls them and tell them there is a high return gold investment scheme they should buy, these aunties and uncles will definitely ask them to fly kite and slam the telephone down. But if it was their nephews, relatives, friends, or friends' relatives who call them, then they will give them a chance to listen. They trusted what the agents said, not the company whom they know nothing about

The existing laws adequately cover those who abet the scheme (ie the agents). So, agents should face the law now instead of waiting for the karma to haunt them later

BNM should exert some deterrent punishment for the agent this time, so that in the future, such similar schemes will be harder to recruit soldiers to help them sell their products

You should show the philosophy to the bank negara officers who are going to investigate the agents, and plead to them for mercy. Hopefully they will be convinced by the above philosophy.

This time, BNM is going after the senior CON-Sultans also. So get yourself prepared. It is important to engage a good lawyer, remember....

What I heard from the insider is that bank negara is now trying to prosecute a few senior con-sultan together with the direcors and Datuk bosses. The will be facing the same charges as those datuk bosses. I heard BNM is quite agitated by these Con-Sultans creating the media wave blaming BNM, until calling them ”perompak”. They did not expect the controversy grow so big against them when they first take action. They knew this media action is started by the con-sultan, not the Datuk bosses

The tax evasion will face only fines, and under the jurisdiction of IRD. Bank Negara now wants a more serious penalty for these Con-sultans. Look at it as a backlash if you wish, but that is how the government agencies exert authority unto their opponents so that future potential law offenders will think twice before taking action

Just 1 question to you : are you a consultant or a senior consultant of Genneva ?

If you are a senior consultant, please go talk to BNM officer before they talk to you. Don't make the same mistake your company did - wait until they raid you only react. That would be too late

While you guys felt deeply on the Genneva episode, what are the lesson you learn from it ?

Looking at the support they got from the customers and Con-Sultans, I really respect the brains of the bosses. They are just genius ! notworthy.gif

Let Genneva bankrupt like what their Singapore operation did, the bosses are all villians and the authorities are heroes.

Let Genneva Malaysia operation being raided by the authorities, they are the heroes and the authorities are villians ! thumbup.gif

The Datuk bosses are now the Robinhoods and Botak Chins.....I sincerely take my hats off to them !
