Well i just did a under rm450 of normal figures including EMS after yen conversion from HLJ and the custom still holding the items.

I remember few people were pretty sure purchase made with EMS shipping under rm500 are not taxable.

Any special criteria for this? Since I never seen the actual Clauses.

hi, custom will open up the stuffs by themselves. I'm not sure if there's a difference between EMS and Registered Mail, as I have packets sealed back before.

And I think they want to tax, the package shouldn't be big, around 1.6kg. And I think it wrote bring a copy of invoice so i'm pretty sure they wanna tax.

So how do I argue? I can't just tell them I hear say things under rm500 cannot be taxed right? Is there any clause mentioned in BLACK & WHITE?

I understand the nego part but...

But if the clause apply we don't even need to pay the tax.

But then the 1980 & 1988 act it's just 2 simple clause I'm not well equipped with law. To what extent the cluase apply to us I cannot be 100% sure. I bet some custom officers don't even know these clauses exist...

Also is the shipping fee taxable?

For HLJ, it is adviced by themselve that you choose non-direct payment 1st, they will send you an invoice regarding the shipping charges. After that you may revert back to Credit Card payment. If you think the EMS quoted is too expensive you have to email them to cancel your order and redo your order again.

I know even they say it's not perfect system. But if you refer the weight of the item against the shipping fee chart it's about there.
