I know it is inappropriate to rise this issue up in this section, since this is not related to the incident caused within lowyat.net
I just wanna know what can i do to raise this issue up..!!

My story:
This is the actual complaint i lodged with nccc.org.my and kpdnkk.gov.my, hopefully they will follow up my case well..

12/12/11 :
Roughly 3pm, I went to Maxis branch to sign up the broadband package, it entitled me to buy motorola xoom at RM299. After signing all the contract (24 months), payment made, and bring the motorola xoom back with me. Everything goes smoothly here.

Try to play around with the Motorola Xoom i got from Maxis branch, it severaly failed me, the device keep restarting itself, hanging frequently. Plan to go for exchange on the next morning.
* Device failed me even less than 24hours, less than 1 day.

13/12/11
About11am. Morning, i went to MotorolaOne (sunway mentari) proven Xoom defect,the staff told me need roughly 2 weeks to solve the device, strictly no 1 to 1 exchange even the device is less than 1day. The staff advises me better go back to Maxis Branch, who knows can 1 to 1 exchange.


About 12pm, noon. I straight go back to Maxis branch and tell them the problems. They detected the problems, however, they told me there is no 1 to 1 exchange for me. Then i argue back, the device is less than 1 day, and im not expecting to go for warranty since the maxis data plan is activated and running, i have to pay monthly commitment fees without using it. If i go for warranty, the waiting period is 2weeks may be more.
This is definitely unfair to the customer since the data plan is running, yet i unable to use the plan without the device.

However, i leave the device at the Maxis branch and the staff said the device can change for new set, if the manager says yes. So, i leave the device there until today.

14/12/11: they haven't call me, so i assume the staff had not gotten any approval from her manager yet. Thus, the device is stil at the Maxis branch.

P/S: i lodge several complaint onto the maxis facebook page and maxis forum. They contacted me, yet they deny their responsibility.

15/12/11: I am waiting for the call from the Maxis branch Subang Carefour. Yet, I didn’t receive any call from them whole day, since they said they will get back to me for the collection of device. So, 8.45 pm, I make 2 calls to the Maxis branch, call is connected, yet nobody pick up the calls. After all, I personally went to the Maxis branch, and the bad news is no exchange for the device. At that time, I suspect what I receive the device is not new set because I saw there is brand new Motorola Xoom, the condition is different compared to my so called new set Motorola Xoom. For ‘new’ set Motorola xoom of mine, the plastic stick on the device screen broken at the edge, yet the brand new set on the table is full covered over the device. So, I suspect the ‘New’ set of mine is actually is not a brand new set.(Maybe this unethical seller know it is the faulty set from earlier, yet stil selling to me to earn profit) At the end, I leave my device there again, since they deny their responsibility as the seller.

Overall
What i think as consumer right vested onto the consumer has the right to change the device for new set, since it's less than 24hours.

I feel unfair because the data plan is running, yet no device to use it. Addition, warranty may need 2 weeks and may be more. This plan cause me RM98 per month excluding 6% service tax.

Also, the maxis branch denies the responsibility as the seller without providing helpful customer service.

Finally, being first, I hope there is 1 to 1 exchange the device from Maxis , if not, i would demand for refund.

For refund, i calculate the rough estimated loss.
Estimated loss:
advance payment RM100
Motorola xoom Rm299
Monthly commitment fees RM98 + 6% ( the first month)
*this also including get rid of my data plan 24 contracts.



Dear forumer, after all , what do your think?
Actually i wanted to post it up at Maxis Facebook wall, yet, i find no lubang to post it up.. lolx..

If I were you, I won't wait until 8:45pm to go there.. go since morning and wait for manager to show his face and talk directly. Make a noise in front of their customer..

I do that in one of customer svc counter at supermarket. I smash their table... I get what I want..

subang carefour? since when got branch there.
only got a small dealer there. the proper branch is at pyramid.

in any case, you have 7 days to cancel the contract.
