When pass them the defect list must ask the developer make a received date stamping.Then, you keep one copy and make one for your lawyer copies.
But before this make sure your lawyer haven't perform full release payment to your developer (usually last 5% haven't release to developer)
If after 3 month from the stamping date developer still haven't perform any fixes on the defect, you can ask fix urself and claim from the last 5%.
(Correct process better consult your lawyer).
But nowadays most of panel lawyer they just release all the money to the developer, side to the developer more than the buyer.
