When i give my betta mirror sometimes he flares sometimes not.but mostly flares,normal ke?

Newbie,sharing,third day I have him.only can provide 2.5 galoon space ,student living in apart (though rules say cant keep pet)

Helppp..my betta is sick,it only stays quiet in the bottom and hard to feed it. It swims miring2 also,seems hard for him just to swim upward to catch his breath. I changed the water already, and what's the next step?
most of the time he rest inside there and swim a little
