I seriously doubt you would want to go legal since only RM6K involved as your legal fees could start anywhere from RM3K and should you lose the case, you will also be liable to pay the bank's lawyers as well. Suggest you try negotiate with them unless you really got a sure win case etc.

tgeoklin, if if happened to you. would you want to settle for more than RM250? If it was me, yah I offer them RM250, it they do not accept, I will see them in court. It's a matter of principle and we should not to be bullied by the banks, furthermore, there have been a precedent as in Diana's case.

Actually it depends on the actual circumstances of the case as I had mentioned over at the OCBC thread. Fyi, I had just only resolved a fraud charge to my CC with the amount close to RM40K but owing to the fact that I had informed within a reasonable time, the bank had managed to recoup the amount, thus I was absolved of all liabilities. This shows that banks can be fair too and are not unreasonable, plus they even absorbed the exchange translation loss, which was over RM1K from forex conversion, without even charging me RM250 etc.

Of course if thread starter really can afford the charges in the event she lose her case, then by all means, pursue the matter, because there is no guarantee despite what well wishers may advise sad.gif

As I had mentioned, pls read thru the entire decision, as the RM250 is only valid provided card holder can prove the charges are "fraudulent" and as for my answer, it would depend on my legal advisor tongue.gif

Fyi, had a friend who fought his case over RM10K and ended up losing ultimately in the Court of Appeals, finally had to settle over RM50K sad.gif

Actually, I think the whole gists of the matter is people are not treating their credit card properly ie. CC is as good as cash and if you are not responsible enough to own a card, then don't. Let's say if your cash is stolen from yr wallet, who do you ask then money back from? The police? Govt? hmm.gif

I suggest TS to nego with bank first without prejudice to legal resort, bearing in mind legal fees etc. Always nego and try find win win solution before fighting, which is the last resort icon_rolleyes.gif

I think the above also serves to highlight the danger of having high credit limit as constantly being sought by newbies rolleyes.gif
