Hmm...
Honestly I have a few thing I am unhappy with

1. Lawyer - Our lawyer 'Mr Ng' is a;ways keeping us in dark. I met up with him 1 month ago where he told me to prepare to sign the SPA+MOT but until today no sound. Also because of the delay for the signing of SPA + Loan Agreement, my bank is pulling back the loan because no disbursement in 1 year which is okay as it was already writte in the earlier LO but this lawyer should step in and talk to them. Bloody hell, now I have to convince the bank to extend the facility
One word - This fella's a crap but we are stuck with him.

2. New Layout - If MS failed to obtain approval for the new layout, it's fine but remember we actually failed 28k for that upgrade so the new revision by MS must be at least equal to what was promised earlier or if he is not revising the build up, please give us some goodies such as auto-gate, air con, water heater, etc to compensate

3. 2 years free maintenance - Now this pissed me off the most. How can they reversed whatever that were agreed earlier. THis is crap la. I'll defiitely not sign the DMC for this until an agreement is reached. And I heard from some owner that it will be more than 150 bucks a month

I have not sign or see the SPA therefore I couldn't comment about my dissatisfaction but Mr Ng know I am hard to dealt with, maybe that's why he hasn't get me to sign the thing because I already communicated earlier to him that I'll only sign if everything is as per the earlier SPA with MH. Therefore for those that has already signed, kindly bring this case to MS via the lawyer. I can't because technically I have not sign and I am only writing this based on what I heard from other owner

Fyi, the lawyer knows about this forum but I am not sure if he actually reads what we said. So Mr. Ng, if you are reading this, kindly disseminate more information to all your 80 plus clients. You can just drop by this forum and let us know what's the current status is as and when needed

It's bloody hard to get you...

Don't worry about Mr Lawyet jeopardizing everything and taking personal 'revenge' over our comment here. From how I look at it, he's doing a good job dealing with MS, just a bad one dealing with us.

Guys,

I went to the site on Saturday for a look.
I have to say that the progress is very good as some units even have the roof done. I was trying to see the fascade and it is definitely different compare to the MH's one but I cannot identify how it will look like as they are still building it. The way I look at it, we are about 40-50% done... that's quick but hopefully MS do not sacrifice the quality

I've seen the balcony in the 3storey/semi D and it is too small to fit anything so I don't see a point of having a balcony. If it is not taken care well, it'll just gather dust and dirt. I would prefer without balcony and the space that the balcony occupied to be part of the masterbedroom, easily get additional 30-40 sq feets...

I think we need to know what is the status right now. The way I understand it right now the layout is not approved by the local council...

i got to know that someone actually "sneak" into the construction side and have a look of the unit that have the roof done.
they said that they saw the "roof(top)" of each room is empty on the 1st floor.
last time MH confirmed that the roof top of each room will be cemented.

which mean will they covered the roof of each room with only wood or how?
what i mean is by right they should covered with cement 1st then only they put up the roof outside rite?

i'm not engineer nor have good knowledge in construction but this is just my common sense.

This kinds of thing very hard to judge as it is not mentioned in the SPA. I guess the best person to answer is the project manager for our phase. They will have everything layout but not sure if they can reveal it to us or not

I think UFO is correct. I think we should bring our concern to TMS with or without the lawyer.

Can we meet up and discuss this with TMS say this Sat (is their office open on Saturday?)

But I need you guys to help me to list down the question to be posted to them.

I'll start the ball rolling

1. Why is the delay in the signing of SPA?
2. What will be the monthly maintenance fees?
3. Will there be a 2 years free maintenance fees after vacant?

Can I know how many agreement are there?
SPA? DMC?

If the changes on the SPA is minimal then I'll probably sign it as I don't think the security fee and club house part of SPA. It should be part of DMC.

Therefore I might sign SPA only but I need to ask about the layout and what is the implication if we do not sign it?! Does MS has the right to void our earlier agreement and kick us out. This I need to ask our dear Mr Ng.

Well guys,

I've signed the SPA and MOT last Saturday. I couldn't wait as my loan will be withdrawn by my bank end of this month
Like what was mentioned earlier by a forummer, the changes to the SPA are
1. Layout - Extension to masterbedroom change to balcony
2. Lighting point, etc

But I didn't sign the DMC as I mentioned to the lawyer that the agreement should be changed to include the free 2 years waive for the Security Fees (and hopefully the club house as well).
He will bring it up to MS. I have also spoken to Samantha (sales girl from MS) about this as well and she was surprised why we didn't have that so she said she'll bring it up to MS. Hopefully will get good news.

Honestly if I have the $$ and time, I'll probably fight this one but sad to say, I don't have the luxury. The only 'loss' I would say is the lost of the extended 'covered' area in master bedroom. And to be frank, I think we actually do not really have a case as MS is actually giving us the same total sq feet as before.

I did asked the same question about the upgrade whether we can pull back or not but was informed to contact MS directly.

I have a copy of the DMC but I have yet to sign it. The lawyer said he'll amend it to include the free 2 years waivers.

We waited for the SPA for god know how long and now they just send us a letter dated 8th June (pos stamped 14th June) and request me to sign the damn thing (which I did on the 11th June). Someone in MS will be getting a good f*** from me soon...

Received a letter from MS for the remaining RM2800 so I went and passed the cheque to MS last Sat. Took the opportunity to talk to Vivian (she's something like a marketing manager for MS) and she confirmed that we (buyer from MS) have the same entitlement as the Semi D for the 2 years waiver even though it was not mentioned in the DMC (apparently it was not mentioned in DMC for other direct purchasers as well)
