Fresh from a high of actually winning RM7k++ from Naza with just paying about RM20, I am here to share the knowledge of how to use the Tribunal to your advantage. Before we begin, pay a visit to the Tribunal website to get an in depth description of what they do Here.
Basically, the tribunal
1. Functions as a type of Majistret court, dealing with claims between seller and buyer.
2. They also deals with dispute over warranty, quality, and service of seller and buyer.
3. The ceiling of claim is RM25,000.
4. The order of the tribunal is of the same power as an order of a Majistret Court.
5. Failure to abide by the order of the tribunal can land you RM5,000 in fines (for as long as the default is ongoing) plus jail - No Play-Play here.
6. Thanks to an amendment made in force starting from Febuary 2011, the tribunal can in certain cases open and review unfair contracts, with elements of the unfair contracts law from the UK incorporated in the provisions.
Part 1 : Claiming
Q : Who Can I Claim To?
A : Technically, anyone claiming to be a seller or in possesion of a SSM certificate, whether ROB or ROC. The presence of the ROB/ROC number sometimes are not needed, provided you have in your possesion the address of business, the receipt stamped with the company name or even the advertisement used.
Q : How Can I File A Claim
A : Simple. Through the TTPM website online, or come to the TTPM offices, situated in major towns all over Malaysia.
