I bought a phone samsung captivate from lelong site.

received it in 2 weeks time and to my dismay it got faulty home key.
the home key will crazily activate itself...It got video inside the phone recorded to prove it( stupid seller).
But unfortunately I didnt save the video file.lol.

Contacted the seller and sent it back.
Received the next replacement phone 1 week or more but again it exhibit problem.
The phone will shutdown itself in screenlock mode.

Again, contacted the seller and he asked me to send it back again.
After some time, I'm pissed with the seller keep dragging time and kept giving me faulty set( in the sell thread he say new but how come got problem?).
And I think I deserve a replacement set.

Called the seller and he say cannot replace other set.Coz It got scratch on the phone and used it for few days(wtf if during those days u scratch u blame on me
then how?I'm sure I havent scratch it and got pics to prove). And talk to me about his T@C of deal in his sell thread...24hrs testing..totally absurd!!!
And ask me why I didnt sent the phone back on the spot.( It fall on holiday and weekends how to sent?) =_=.
and he promised to replace the board etc for the phone.(what? Just few days old and the board got problem? what kind of new phone is this?)

Until now I havent received it.

Chronology of the deal in the spoiler( in BM...gonna forward to TTPM etc).

» Click to show Spoiler - click again to hide... «

Cannot rate the seller "bad" now coz it's over 45days after deal. This is absurd...the lelong system.I've leave a feedback to lelong.

Receipt was confiscated by seller in the end.In other words he meant " No more warranty for you wise guy!"

Call up lelong and explain your case to them and call up the seller to tell him this. If seller is a fulltimer he believe he would gladly refund you rather than risk getting suspended.

It wont be that easy to get a "Store" member to get suspended.

I've reported and I'm just glad there's respond from lelong.

But lelong seems turn a deaf ear to issue I complaint to them.

Just mere "ok sent the item to buyer ya seller".

already stated 2 months of wait and 2 non working set plus wasted my shipping.

and best of all accused me of scratching to phone.

Does this sound fair to me not to get any kind of compensate? lol...

this kind of seller also can do business?

I'll make sure this case go as "loud" as possible.

from what I've search.

Those were the common problematic set in US.

the only way out of it is to exchange.

The way the seller twisting this fact was blaming me to flash the phone
or damaged by me.Very pissed. vmad.gif

If the set is okay then the seller is okay.

But judging from my case, when dealing with a problematic set.
He will manipulate the facts in order to protect his interest.
what a seller....u judge by urself ppl.

in the end got the phone.

working order but still... the phone got a dent corner.

which indicates the phone is a cosmetic flawed unit.

but now already lazy to complaint.

deal with caution with him and give feedback to lelong accordingly.

i see lots of good prices from that seller. but then the orders took long time especially the auctions and from reactions the stated brand new are not really, worse some faulty. i've nothing against the seller cos i haven't tried dealing with them, but this reflects more that "You get what you pay for" sad.gif

it took almost 3 months for me to conclude the deal.

the warranty period took a lot of time.( for him )

I saw a few "bad ratings" given but retracted....he somehow manage to "sort things out".

Just received this in my email, and coincidentally i was reading ur thread.

QUOTE

Contract Law In MALAYSIA

Legal Issue on Contract Law in Malaysia - Good for us to know

This is something I like to share with you from one of my seminar recently. If you find this informative, pls circulate. It was conducted by A/P Catherine Tay on Legal issues in E-commerce.

Notice that most of the time, the receipt / invoice you received from the merchant carries this exclusion clause or similarly worded statement: 'Goods sold are not returnable' or 'No refund once sold'.

The thing that I have learnt from her is that : 'As long as your good is purchased for home use and not for business ( i.e. to be resold), the above exclusion clause is VOID.

That means, as long as the good is defective, regardless of what is worded, you CAN get back all your money spent. You do not have to accept a repair on the good or an exchange. You CAN ask for a refund. AND you are LEGALLY right and entitled to! What a relevation!!

And most of the time the merchant will refuse to return you your money.

Her advice? >From her own experience ( and no less than 7 and all successful!) , she will threaten the merchant with four words: 'SEE YOU IN COURT!'

The court here refers to the Small Claims Tribunal Court .

However, you don't have to tell them what court! All you have to pay is RM10 admin fee and the loser (the merchant) will have to refund you the money PLUS the admin fee!

She shared this with us because she felt that even educated people are cowed by such unfair wordings (which includes her jaded friends who are not lawyers).

Pls try not to let the merchant fleece you the next time you have a defective good.

I know where to file this. On the 16th floor of Putra Place (The Mall opposite Putra World Trade Centre) . The form cost RM5.00. The Tribunal will settle within 2 months period.

Tingkat 16, Putra Place ,

i saw a guy with a lot of gd rating in lelong sell galaxy mini. Go to his shop and COD the phone . The seller claimed its new and SD card slot is spoilt when i tested in my room. luckily the seller refunded full amount. Bought it at Samsung Elite Partner instead...its not worth getting phone thru online and get all the hassle !

Seller repair the set as he said ( but i think its another machine...judging from the outlooks of it.)

This was after long period of waiting.

Didnt include the sales receipt to me in the phone...end up waiting another few weeks for the receipt again.

In the end just emailed me the copy...lol.

There's lots of hussle and bustle for my deal with him.

This seller happens to be one of the "Bad apple"

My point is there's a lot of seller out there with good business practice...but undeniable there's some not so good one.

I've dealt quite a number of trades in Lelong...all is satisfactory and good except this one. shakehead.gif

But the best practice is to buy direct from shop.By that way u can test and see the actual model of the shop.

I didnt expect things will came out like this after my case!
I feel for u guys. This case is just like strongbaby case.
Even b4 this the seller had told the buyers their stock had been stolen n urged the buyer to wait or change to another phone.I'm the one to wait and get a faulty phone. And this is after 2 months of waiting...nearly.

Since these were lelong cases.I suggest u guys to report via lelong feedback and confirm with their admin and take nessasary coarse of action against them.
For my last experience lelong admin won't take long to reply complaints.

Good luck guys and let us know the outcome ya
