No. That should not be the case.
It clearly says in Lampiran A, 9503.00 that dolls, reduced size (scale) models and puzzles that were subject to 5% import tax would now be tax free.

check here, 9503 is the HS code. If you are being taxed, then i fear it is the kastam kakis making a quick buck.

Import duty exemption is on goods, and is not based on individual/syarikat, as far as i know.

Sales tax, I have no idea.

Lampiran A, which is the relevant one here makes no mention of 'syarikat' mind you.

It corresponds to Lampiran 8, which also does not mention syarikat.
You do realise how illogical your arguement sounds, don't you? If a budget announcement is made regarding a general reduction of import duties based purely on the nature of the goods BUT is not to be applicable to individuals, then surely by the same logic all good of such nature were not to be subject to import duty when imported by individuals?

Sales tax, unfortunately, seems here to stay. Going thru the acts right now to check.

I get what you mean as one my earlier audit client does have to apply for a license to waive import duties under this act previously. This is what is covered by sections 174.

However, the statement by our 'dear' Najib during his budget announcement made no mention of the act and was a blanket thing. Hence, as per the normal import duties you have to pay when lugging back loads of liqour from your ocerseas holidays, the same should apply. If you read carefully, the lampiran actually meant that items not in the list already attract waivers under section 174 (which iirc is for luxury goods).

At any rate, emailed kastam d. Sales tax unfortunately is 10% and seems unavoidable.

As for Thor, tak suka lor. Never liked the character from my comic reading days... me biased.

OT: I miss working... used to be able to go up to the office library and check all these custom rulings and company laws... the customs webpage and google are a pain to use.

Called my ex office kaki though, sales tax IS fixed at 10% for both individuals and companies. Import duties he isn't sure. According to him, Najib sometimes talks out of his arse.
