 Suspicious Telephone Calls on CC matters, Report here & Read this if you got a CC

My sister received a call from this company called Milliken & Craig Group, claiming that she owed outstanding Credit Card debts to XXX Bank Malaysia. The interesting thing is my sister never had any accounts whatsoever with XXX Bank Malaysia.

So, she told them that it must be a mistake, she has no CC or any account with XXX. The caller gave her Name, Contact Number and it was correct.

My sister then asked them to give the NRIC Number in their records and they refused, instead, asked my sister to give hers. So, my sister said, “I am not STUPID to give my NRIC Number to a complete stranger over the phone”.

But the caller insisted and asked my sister for her NRIC Number. So, my sister asked for the caller’s full name and NRIC Number. The caller than started to get defensive and would only give her first name (sorry, forgot already) and refused to give her NRIC number and hung up the phone.

My sister then called up the XXX Helpline and explained the situation to them. The CS at XXX then checked my sister’s particulars (she gave her NRIC Number) and XXX confirmed that my sister has no Account with them. The CS from XXX further said that XXX does not outsource its collection efforts to any third party in MY.

My sister also did one additional step which was to get a CCRIS Report from BNM which also showed that she had no Credit Facilities with XXX Bank.

The interesting thing is after a few days, my sister again received a call from Milliken & Craig Group again asking when she is going to settle her outstanding CC debt with XXX. So, my sister tells the caller that she has verified with XXX and CCRIS and she has no Ootstanding with XXX abd threatens that if she ever receives a call from Milliken & Craig Group again, she will make a Police Report for Fraud and Extortion.

So, after that she did not receive anymore calls from Milliken & Craig Group.

Now, this could be a simple case of mistaken identity but for the record, the caller from Milliken & Craig Group was very rude to my sister throughout all the calls, demanding payment even without first verifying the identity of the other party.

So, just be careful of a bona fide collection agency calling and claiming that u owe them money.

Apologies that I forgot to take down the number that called my sister but I did call up Milliken & Craig Group using the number listed on their website and spoke to their Rep who confirmed that their Rep did call my Sister. I also gave them a piece of my mind on their SOP and also threatened to lodge a Police Report if ever my sister receives another call from them.

The answer is Yes, if the Creditor can get a Court Order to that effect, but it won’t be easy to get such a Court Order. The Court Order also cannot cover Assets which are pledged to other Lenders such as Cars under Hire-Purchase or Houses under a Mortgage.

Also, the threshold to declare someone bankrupt is RM30K. Below this amount, even many Banks do not bother to take Court Action unless they know that you are rich (say driving a BMW) but refuse to pay your Credit Card / Personal Loan of <RM30K.

Yes, the Court does have the authority to issue a Warrant of Arrest but why would the Court do that when it is easier and more beneficial for the Plaintiff (Lender) to obtain a “Judgement in Default” and merely serve in on you and get you to go through the appeal process which is more costly and complicated for you as the Defendant (Borrower)

Judgement in Default means “a judgment entered in favor of the plaintiff when the defendant defaults (fails to appear in court)”

There are thousand of cases going in Court every day and especially at the Main Courts in Jalan Duta. Hence, it would be very rare for someone claiming to be calling from Komplex Mahkamah Jalan Duta to call you. The probability is that this person is not a Court Official but perhaps either a Debt Collection Agency or Lawyer that has been appointed to pursue legal action.

Its of course, illegal to impersonate another person, especially a Government Official. Next time, ask for the NRIC of people claiming to be Government Officials, togetrt witht their ID Number, Office Number, specific Department, etc..

This is a common tactic to get borrowers to pay up. Whether its legal or not, I will leave it to Lawyers to answer. I am actually not a Lawyer. But even if its illegal, what is your recourse then? Make a Police Report which will only serve as a formality? Do you have money to engage a Lawyer and sue them for damaging your reputation. That would be unlikely.

Son, some sincere advice.

You owe, you pay. If you cannot pay in full, pay in instalments. I take it that you’re still young, say < 30.

You have a long way to go, don’t tarnish your financial / credit history. Its difficult to erase such black marks.

Added - just saw that your Dad fell ill. Hope he is better.

Yeah, life is difficult sometime, made a mistake and shall not do it twice. The mistake was not done by me, but caused by the surrounding and fate, which give me no other option.

I am not sure if there is/are letter(s) sent to my house as I have moved to my parents'. The address written in the CC registration form was my previous rental room house.

The lady "K" refused to allow me to pay in an installment mode, that is my concern. Can a bank do this? I didn't stop paying for long, just for 5 consecutive months and have made 60% of the debt cleared.

Under our Banking rules, you're a NPL if you missed payments for 3-mths or more. So, i used to tell my friends, the key is 3-months. So skip 2 payments, make 1-payment if you have to but don't miss 3 or more consecutive months.

This is only for your Credit Card right? Have u tried using the said Credit Card? What about your other Loan obligations, have you paid duly.

You have a few immediate options:

First Option

Call your CC that you are owing and speak to a appropriate senior person in charge to find out what is the current status of your debt. Have their outsourced it, taken legal action.

This is your most viable option as AKPK does not accept cases which has reached Legal Action. Even if your case has reached Legal Action, go to the Bank Branch and speak to the Manager. Show proof that your Dad was sick and hence, the cause of your temporary financial troubles.

If the Banks refuses to withdraw Legal Action and let you pay in instalments, go and see MCA, Malay Mail. You can still try to appeal to AKPK for help.

Second Option

Go to AKPK and tell them your financial predicament. They will ask you if it has reached Legal Action to which you can tell the truth that u have no idea. You can share the story of the Court Official with them and see what they say.

I don't recommend calling the Puan K as I think its a scam. She is probably working for the Collection Agency, etc.

Replied you in the Citibank tread. For the benefit of the rest, this call is to sell 'Credit Shield' which is a form of Insurance that will pay your CC Outstanding including those that you swipe up to Statement Date for a price. its not a suspicious call per say, just remember that it will cost you money and it will be effective until you call to cancel and even if u have no Outstanding, a premium is still chargeable for the sums that u swipe up to Statement Date.

Just to share on how to handle suspicious calls. Recently I got a call from a Bank to say that my CC had been compromised and they wanted to issue me with a new CC.

Our conversation went something like this:

CS - Can I do some verification
Me - Fine
CS - Can u give me your NRIC Number
Me - How can I be sure that you are really calling from XXX Bank. Can u give me my last 4-digits of my CC

CS - We cannot reveal customer data
Me - But there is no way I can be sure you are calling from XXX Bank. Can u give me one merchant that I have auto debit with
CS - We cannot reveal customer data.

Me - Then, I cannot reveal to you my NRIC Number
CS - But your card has been compromised. We have to block your card and issue you with a new card. Do u want your new Card.
Me -Yes of course, but BNM says don't reveal personal info over the phone to strangers

CS - okay, I will get the system to send you an SMS to call by the Helpline. Is that okay with you
Me - Yes

So, the CS puts down the phone and I get a sms immediately to call my Helpline and that my card has been compromised.

So, I call the Helpline and true enough, my card had been compromised and I was issued a new card.

So guys, remember, never reveal any personal info to strangers over the phone.

yeah, as it appears on the CC Slip. That's why I also asked for my merchant auto-debit.

But yes, its best not to continue and call the Bank yourself / myself to verify.

Some European Countriers have started to practise the PIN for CC. When it was first intoduced, almost all Card Holders had to be issued new CC as most have forgotten or thrown away their PIN Slip.

Also, it has caused a lot of congesstion when paying at Restaurants, etc.

So, Banks in MY are not keen to implement PIN and with the SMS Alert, Fraud has been reduced.

So, the trick is to request for lower SMS Alert and if your Bank refuses, either complaint to BNM or cancel your CC

I got call from RHB Clone number at 9206 8118 and with automated messages saying pending transaction

I just hang up the phone and called back RHB directly and confirm no such transactions.

Hmm, should give rotan to all these scammers even if they are women
