Received a call from RHB Bank. Dept Collecting department (+603-92878888) said they didn't receive any of my CC payment overdue for 3 months. I DO NOT HAVE any RHB CC, and he manage to tell me my full name and IC number, even address. I just hung up.

Reported to RHB call centre...

*How the hell they can use exact RHB numbers...

Recently I keep on receiving calls from 011 number. Call regardless of time, sometime in the middle of the night, sometime early in in the morning. Previously was call until pick up, but then never say anything. Until I got annoyed and asked a guy fren to answer, then the number stopped calling. Tat was two weeks ago. Yesterday started again, this time only play miss call. Ring two times, hang up. Anybody have experience of this?

Guys, i'm kinda in pinch right now, needed help..

Last week i got a call from a blocked number, saying they from "MyClinic" which is from government body,
They said got collaborated with all banks..
Then she verified my name, and then she read half of my Maybank Debit Card number, and asked me to read the half,
Well stupidly i read it, and she asked for the card expiry date and the 3 security number behind the card, and again stupidly i gave it..

She said they will send a card with policy,
Which is the fees are RM200 for a year,
and said i have choice to accept it after the policy arrive.
She then said another number will called me to verify my info again..

Few minutes later a called came in,
Here is the number - +60 3 7626 6800

Realizing my mistakes giving my informations,
I immediately go to the nearest ATM and take out all my money and transferred it into my another bank.

Today, a blocked number called me,
A guy, with annoyed tone in his voiced claimed to be a staff of MyClinic, said i have due RM200 payment,
And if i didn't paid it before Monday, they're going to file a lawsuit againts me..

I said that i didn't received any policy yet to read,
But he said i already agreed as last week during the second call to verify my info, is the time they take that i have agreed,
They even threathened me as they said they have voiced call record for that, and said do i have evidence i have not agreed..

What should i do?

You are clear about the bolded part right?

The next time, they give you a call, ask for the staff's name and location of the office. Tell them you will need this info to lodge a complaint to Bank Negara, let's see if they will furnish the voice recording as evidence if they really file a lawsuit.

You may also report this to Maybank and check if they have any connections with this MyClinic.

this is general tactic.. all card sharing the same half front no.. that s why they can tell the first half card no.. then they will let you say the other details and get the security code..

link below tell how they try to trick you to get all your credit card details.. please beware and not giving your details to strangers especially on phone..

My sister received a call from this company called Milliken & Craig Group, claiming that she owed outstanding Credit Card debts to XXX Bank Malaysia. The interesting thing is my sister never had any accounts whatsoever with XXX Bank Malaysia.

So, she told them that it must be a mistake, she has no CC or any account with XXX. The caller gave her Name, Contact Number and it was correct.

My sister then asked them to give the NRIC Number in their records and they refused, instead, asked my sister to give hers. So, my sister said, “I am not STUPID to give my NRIC Number to a complete stranger over the phone”.

But the caller insisted and asked my sister for her NRIC Number. So, my sister asked for the caller’s full name and NRIC Number. The caller than started to get defensive and would only give her first name (sorry, forgot already) and refused to give her NRIC number and hung up the phone.

My sister then called up the XXX Helpline and explained the situation to them. The CS at XXX then checked my sister’s particulars (she gave her NRIC Number) and XXX confirmed that my sister has no Account with them. The CS from XXX further said that XXX does not outsource its collection efforts to any third party in MY.

My sister also did one additional step which was to get a CCRIS Report from BNM which also showed that she had no Credit Facilities with XXX Bank.

The interesting thing is after a few days, my sister again received a call from Milliken & Craig Group again asking when she is going to settle her outstanding CC debt with XXX. So, my sister tells the caller that she has verified with XXX and CCRIS and she has no Ootstanding with XXX abd threatens that if she ever receives a call from Milliken & Craig Group again, she will make a Police Report for Fraud and Extortion.

So, after that she did not receive anymore calls from Milliken & Craig Group.

Now, this could be a simple case of mistaken identity but for the record, the caller from Milliken & Craig Group was very rude to my sister throughout all the calls, demanding payment even without first verifying the identity of the other party.

So, just be careful of a bona fide collection agency calling and claiming that u owe them money.

FYI, website of Milliken & Craig Group.

http://www.millikenandcraig.com/

Apologies that I forgot to take down the number that called my sister but I did call up Milliken & Craig Group using the number listed on their website and spoke to their Rep who confirmed that their Rep did call my Sister. I also gave them a piece of my mind on their SOP and also threatened to lodge a Police Report if ever my sister receives another call from them.

Hi All,

I would like to share my experience, where I received a call yesterday from someone name Pn Sharifah, she mentioned that she is from Kompleks Mahkamah Jalan Duta.

This is pertaining to my overdue credit card with XXX bank. Which I have failed to pay monthly payments for few consecutive months. My bad. I agreed.

She then, asked for my I/C number which I refused to. Then she asked for my full name for checking. This Puan then do a checking on her system (I guess), and spelled out my I/C number, and total amount of due which she reiterated that XXX bank has ordered her to file a case upon me.

She informed me that by 3pm today (yesterday), she will file a case upon me and I will be asked to attend for hearing on 10-Jan-13 which is Friday. Told her that I wouldn't be able to make it cos hey! its a weekday. She then says if I failed to attend, a warrant will be issued to me and I could be arrested.

She also mentioned that during the hearing day, I will be asked to settle total amount of overdue with XXX bank at the same day PLUS lawyer fee amounting RM3.5k, should I fail to, a warrant of ceasing my property will be issued directly.

She asked me to call this lady "K", saying that she is the one from XXX bank whom instructed her to file the case where maybe I could discuss to put on hold this case.

I then call this lady K, and she said if I pay total amount of I owed XXX bank by today (yesterday), she will uplift the instruction. I told her that I do not have that amount of money today, it is impossible for me to have it. The cost of living has rise greatly with my family which is now having financial problem due to my dad suddenly fell ill and is unfit to work.

She is okay for me to pay at least RM4k. Which I did. And she is asking me to pay the balance within a week time.

___________________________

Question :

1. Does the court really have the authority to cease my property?
2. Does the court really have the authority to issue a warrant to arrest me?
3. Do you think this Puan is really from Kompleks Mahkamah or she's just an agent from debt collector company?
4. Is it legal to disguise as someone from Kompleks Mahkamah?
5. That Puan also tried to blackmail me saying that she's gonna refer me to my superior (my boss), should I fail to adhere to the request. Is it permissible for her to reveal my situation to third party?

___________________________

I hope someone could help to answer these questions.

Thanks

Regards,
Lollipop

Question :

1. Does the court really have the authority to cease my property?
The answer is Yes, if the Creditor can get a Court Order to that effect, but it won’t be easy to get such a Court Order. The Court Order also cannot cover Assets which are pledged to other Lenders such as Cars under Hire-Purchase or Houses under a Mortgage.

Also, the threshold to declare someone bankrupt is RM30K. Below this amount, even many Banks do not bother to take Court Action unless they know that you are rich (say driving a BMW) but refuse to pay your Credit Card / Personal Loan of <RM30K.

Yes, the Court does have the authority to issue a Warrant of Arrest but why would the Court do that when it is easier and more beneficial for the Plaintiff (Lender) to obtain a “Judgement in Default” and merely serve in on you and get you to go through the appeal process which is more costly and complicated for you as the Defendant (Borrower)

Judgement in Default means “a judgment entered in favor of the plaintiff when the defendant defaults (fails to appear in court)”

There are thousand of cases going in Court every day and especially at the Main Courts in Jalan Duta. Hence, it would be very rare for someone claiming to be calling from Komplex Mahkamah Jalan Duta to call you. The probability is that this person is not a Court Official but perhaps either a Debt Collection Agency or Lawyer that has been appointed to pursue legal action.

Question :

4. Is it legal to disguise as someone from Kompleks Mahkamah?
Its of course, illegal to impersonate another person, especially a Government Official. Next time, ask for the NRIC of people claiming to be Government Officials, togetrt witht their ID Number, Office Number, specific Department, etc..

This is a common tactic to get borrowers to pay up. Whether its legal or not, I will leave it to Lawyers to answer. I am actually not a Lawyer. But even if its illegal, what is your recourse then? Make a Police Report which will only serve as a formality? Do you have money to engage a Lawyer and sue them for damaging your reputation. That would be unlikely.

Son, some sincere advice.

You owe, you pay. If you cannot pay in full, pay in instalments. I take it that you’re still young, say < 30.

You have a long way to go, don’t tarnish your financial / credit history. Its difficult to erase such black marks.

Added - just saw that your Dad fell ill. Hope he is better.

Did you receive any Letter of Demand from the Banks so far? If no, please go to AKPK for help. Google AKPK for the website and follow the links.

Thanks for your inputs.

I do not plan to take any legal action even if it is proved that the caller was not an official. My concern is just that, I wont be able to pay the balances, around another 3k by next week, hence explains reason to my questions.

Yeah, life is difficult sometime, made a mistake and shall not do it twice. The mistake was not done by me, but caused by the surrounding and fate, which give me no other option.

I am not sure if there is/are letter(s) sent to my house as I have moved to my parents'. The address written in the CC registration form was my previous rental room house.

The lady "K" refused to allow me to pay in an installment mode, that is my concern. Can a bank do this? I didn't stop paying for long, just for 5 consecutive months and have made 60% of the debt cleared.

Thanks again

Rgds
