when you are playing the game, you press the Home button to put the game on pause mode while you access things in your Home Screen (Notes App, Friends List, etc)

faulty unit? while you are in the game, pressing the Home button should bring you back to the 3DS Home Menu. the button is rather hard tho, press harder
