Actually you do have rights under the Sale of Goods act 1957

Which means that if the seller sells you an xbox which he claims hasn't been modded but it turns out that it has been, you can make a claim against the trader. Which means to either replace the xbox or refund your money. Otherwise you can take him to small claims court. edit: just be nice to him but if he refuses threaten to take him to court.. i'm sure he won't like the attention of the authorities.
