Anyone can register with SSM. I can register with SSM using ABC Company, saying I'm a eRetailer, but infact I could be doing Sundry kedai runcit. SSM don't investigate. I can register ABC and open a bank account, and later after the SSM registration has expired, I can still continue to use the bank account. SSM is just a place to register "stuff".

I once won a case when the seller's ad was misleading, etc. Misleading can be in many forms, such as pictures does not match the description or item, small fonts, certain clauses not visible, or those description that are visible but then they are not related to the ad, etc... many ways to mislead a person. Be careful.

lexus150, i saw your PM first before I read this post, so I didn't know what was it about.

OK, I'm sure some of you heard of small claims court. I believe someone's parents are lawyers so please advice if my sharing is not entirely right.

Go to small claims court, take a form, pay RM10, fill in and submit. Prepare all your details and claims. Highlight those that matters, in your case go according to time sequence. This is why school presentation is important, because you really need to organize everything according to your benefit and present to the court.

With small claims court, you would have to do everything yourself, unless you want to engage a lawyer. Prepare your case, present the subpoena yourself, even prepare the subpoena yourself, and all other documents all by yourself. But it is a great learning experience. I am just sadden by the fact that many lawyers have eyes only for money. No money means no talk. Not even a bit of advice. They feel so strong about these things, even very rich ones with high status. When they need IT advice, they come and hope to get things for free!! (Just my rumbling about lawyers)

Anyway, back to topic. Even if you win at small claims court, there is still enforcement part. If you can find the person, then he has to pay or otherwise you can get the law to go after him. If he is not to be found, then the situation becomes difficult.

Usually, conman would have prepared the "back down" or "escape" route. So you need to understand their entire plan, then only take your move and have all of them captured.

I had a malay who is a pro con artist. Everything he and his wife does are truly like Gloden Globe award winners. Now, they are not to be found, and I have no choice of doing anything. So don't "hit grass scare snake".

Actually, in my understanding of law, if anyone of you write things here without the intention to bad mouth any company, then it is difficult to sue you in court, especially if the company is a seller. As a seller, these are opportunities to arise as a responsible company, and to make clear of what is not. If the seller wish to sue the writer as of what is written so far, from what I see, then by all means go ahead. I have 100% confident that the court will find the company who is the one having ill intention.

and yeah, geopchai, i think you make a right decision to open this thread, dont worry lah about the lawsuit, they just play games on you. but surely if i was cheated by this company, surely i'll make them eat my knuckle fist when i meet them. lol

Mind sharing the police report reference number so that the victims can refer your case to this case and perhaps they are the same guys!! Whether there is a refund coming on 8 Aug or not, I think it is already beyond just the refund.
