Hi everyone
Need some opinion - got a customer pay me using a fraud credit card, the 3rd party credit card service provider is holding the payment.
My question are-
i- Where should I report it ? Normal police station or any other specific government department ?
ii- Can I sue the guy for fraud or should I gang up with the 3rd part credit card service provider & sue the fraudster for tying to miss lead ? Should I report to the bank as well ?
I have all the conversation & payment proof in my e-mail, black & white. I have the credit card number & name as well.
iii- After I log the report with government authorities, can I get more info from the telco company & bank about the fraudster so I can proceed with suing asap?
Some wise comment/s will be very much appreciated. Please do not spam.
Thank you
In a case where the card holder reports a transaction as beiung fraudulent, the service provider will hold the money and ask the retailer (in this case, you) to provide proof of buying, which is the transaction slip. As long as the signature of the card holder matches the transaction slip, then the provider would release the fund.
If it doesn't, you are done. The agreement between you and the card provider is spesific regarding fraud - the onus is always on the seller. That's why when I was with someone before my government days, we always are double, if not triple carefull when people are paying with credit card, and are suspicious in their action.
1. Reporting is to the police department. This is under the penal code, section what I forgot.
2. You actually know the guy? Even then, no, the card service provider will not really join you in suing the fraudster. Using a fraud credit card is a crime, and not a civil matter. Since its a fraud matter, how sure are you you have the right person.
3. Fraud? Not really. The only way info is going to be released is a police report, even then, don't think it would be to you.
