 Car Wash Bay Facilities, Our right or just an option?

Hi guys,

I ll go straigh to the point. Most of us in Klang Valley stay in a strata property (ie. condo, apartment etc.) and I have always wondered whether developers are required (by law/mandatory) to provide a designated car wash bay(s) for residents to use irregardless of alternative paid cleaning services (commonly guys in bicycles with the water bin) being offered in the property. On top of this, can the Management/JMB have the right to refuse access to the facility if it exist in the property?

I believe its good to know, us as house buyers/residents of our basic given facilities.

I have been trying to do some research on this but honestly couldnt find any.

There are some properties which from start do mention of such facilities from low to high end.

Just trying to ascertain if it is a given right.

Please do share if you have experience or came accross some guideline/act which does mention it.

some condos cant even wash ur own car in peace. dunno how they ( car wash operators) get permission to operate there.

I know wat u mean. If the management is very adamant of "persuading" residents of using these operators, high possibility of somebody is making money.

I hav been told a lot of reasons like good income to management office, pays for the utilities of the public areas, better control of facilities, other residents complain n so on.

You can always bring in up in the JMB meetings.
However, one thing to consider - i.e. who's going to pay for the water usage if there's a designated "pipe" for waters.

Thus usually someone would need to bring up the notion and bring in someone to wash thus a car wash business is set up within the compound.

That's my opinion.

Thanks bOOn. Usually that would be the proper approach in getting the approval from the JMB. What if the members of the JMB is in the take, they would be persistent in forcing you to use their operator's service.

Unfortunately the scenario is the car wash operator was appointed without being tabled in any of the residents meetings. Management has at one point mention of the car wash bay in which residents can access but now have retracted it.

Just like you mentioned bearing the cost of the water. All condos that I came accross that have this facilities absorb the cost (thru the collection of maintenance fees).

For discusssion sake, say I do not use the pool at all but I m paying for the maintenance of the pool. Fair? The question woud be is there a mention in any guideline which specifies that all development of condos must have a swimming pool? The same goes with a car wash bay.

Dont get me wrong, I m not nick picking on such a small issue but at least as a home buyer/resident we should know what is our right and what is held at others discretion.

I was hoping if someone can verify of a guideline/act that can clarify this.

That's a good question, but am not really sure.
However, it's usually stated in an agreement what sort of amenities and maintenance you're paying for with the monthly maintenance fee. Be it issued by the maintenance office and could be amended when the JMB is in force. The nitty gritty am not sure, but usually that's the case. Thus the need of justification whenever there's a raise in maintenance fee collections.

There's a pinned "lawyer consultation" topic by dariofoo, maybe you can ask about whether there's any legality implication in the collection of maintenance fees.

Why I bring this up? Petty as this may sound but most housebuyers do overlook or at times neglect these other facilities in which we may possibly live to regret once you have moved into your dream property. Its not just about car wash facilities only. Facilities that concerns our security and also convenience as well.
