Hope someone can give me some advices. I am already very frustrated to deal with this kind of Lawyer.

Let me share my story (i try to cut it short):

I bought an apartment. And I am dealing with the Vendor directly without going through Agent.

The Vendor has her owner lawyer (who is her sister's friend). I was convinced to use the same lawyer by the reasons given that:
1) Her lawyer is Maybank's Panel Lawyer (I was looking for Maybank's Panel Lawyer. I do have my another Lawyer but they are not under Maybank)
2) The lawyer said this will speed up & smoothen the process.

So i paid 2% deposit on 30/03/2011.

The Lawyer later told me that they are not Maybank's Panel Lawyer!!!

I cant believe there is this kind of lawyer around... shocking.gif I have no choice but to engage another Loan Solicitor then. shakehead.gif

Since then, the lawyer has been kept delaying & dragging. I complained to her (the lawyer) and she admitted that the Vendor asked her to drag as they are still looking for a house.

After some ting ting tong tong, the SPA was only signed on 13/05/2011 (more than 1 month from the day i paid the 2% deposit).

And the SPA was stamped on 24/05/2011 (even with some unfilled info like carpark no. & the Vendor's bank info).

Just when i tot the nightmare was finished, the Lawyer never stop delaying & dragging!

She (the lawyer) always gives empty promises & excuses for handing me the MOT & other documents for my signature. I sent email to her but she never bother to reply. My loan solicitor is also fed up with her bcoz of her empty promises to furnish her (Loan Solicitor is also a lady) the documents.

Until today, i am still waiting for her to furnish me the MOT & other related documents for my signature despite the fact that the SPA was stamped on 24/05/2011 (which was more than 1 month ago!!!). rclxub.gif

She (the SPA lawyer) has been sitting with the stamped SPA for nothing! vmad.gif

I am really pissed off and considering to complain to the Bar Council but i am still trying to settle it nicely. mad.gif

You must know the difference between appointing the vendor's lawyer AND authorising the vendor's lawyer to act on your behalf. If the lawyer is indeed on record for the vendor, then you are deemed to be unrepresented. If the lawyer is recommended by the vendor, but it is you who are paying the full scaled fees, then she is your lawyer and not the vendor's lawyer. She must act in your best interests.

I edited this because I noted that in you had opened a topic in the open forum and you stated that it was 'vendor's lawyer'.

If she is your lawyer how can she take instructions from the vendor to delay things?  doh.gif  How lovely it would be if you can get her to put that down in black and white  laugh.gif

Yes, i am the one paying full scaled fees to the lawyer. So she is supposed to act for me. But in this case, since the Vendor's sister & the lawyer are friend, she is more siding to the Vendor instead of me. shakehead.gif

Yes, this is the main problem i am facing & get frustrated. She just never learn although i hv sent her several complaints about this.

U r right, it is Freehold. In my case, the 3+1 month will only commence when the MOT duly executed in favor of me. Maybe that's y she keeps delaying for the sake of helping the Vendor to get their house.

I have no idea how to get her to confirm the appointment in B+W.. blush.gif

Btw, the Developer has agreed for a Double Transfer instead of Direct Transfer (it has not been transferred to the Vendor's name yet). May i check with u, is the waiting time required for Double Transfer will be about the same as Direct Transfer?

Sadly the Developer does not allow for Direct Transfer. The lawyer has forwarded the letter from the Developer to me. I also curious to know y they canT do direct trasfer since no MOT been prepared yet to Vendor. doh.gif

I called to the Developer & was told that it is going to take about the same time as Direct Transfer since 2 forms will be submitted together for the transfer. I dunno how true is it... blush.gif

I sent the SPA lawyer an email asking her why does she needs so long to prepare all the things, given 7 days to her but she didnt bother to reply despite a reminder was sent to them via sms.

She (SPA lawyer) sent an email to my loan solicitor on 30/06/2011 that she had sent the docs/info required (ori stamped SPA with all info filled) to her (loan solicitor). But She lied!

She sent another email to my loan solicitor on 4/7/2011 with the attached ori stamped SPA & other info required. From there i know she was lying and my loan solicitor is also frustrated with her.

As she did not reply to my questions after 7 days from my email, i sent her an email to put into record of her ignorance on 12/07/2011, Tuesday. I also asked her a few question & giving them 7 days to reply, as follow:
1) Have the Vendor signed & paid for their MOT?
2) Have the Vendor executed the MOT as at today?
3) Any other outstanding issues from the Vendor?
4) The balance amount i need to pay including the estimated amount for the stamp duty.
5) Any other outstanding issues you need from me?

She didnt reply to me yet. I dun think she will reply to my questions. I am in fact gathering all the evidence before i make a complaint to the Bar Council and terminate them as i think i m totally ignored & not represented!

My questions are:
1) Can i terminate them but use back the same stamped SPA?
2) As she is ignoring me, she lied, she keep delaying & she failed to answer my questions, she has failed to perform her task professionally, so can i ask them to compensate me for all the extra costs of engaging a new lawyer?
3) Is there any risk if i terminate them? From the reasons above do i hv strong ground to terminate them?
4) She put in her letter to my loan socilitor that:

The purchaser(s) have paid all our fee & disbursement in respect of the SPA


Wat is quoted to me was nearly 9-10k but i only paid them RM3k as of today. I dunno what is the actual meaning of her statement above.
5) Any other advice(s) from u??

And i think most of the lawyers will not take this kind of case right? hmm.gif

Answers to your questions:
1) Yes. It does not affect the SPA
2) No you can't, but you can complain to the A&S DB.
3) What risk? It is a contract. If you're not happy with the services rendered, you terminate their services.
4) Whether or not fees are paid, that is a different issue altogether. It doesn't mean that she doesn't do her work professionally. Keep the letter as further evidence in your complain against her.

There are roughly 2000 law firms in Klang Valley. Out of that, at least half, or more than half, practise conveyancing. Am sure you'll find a replacement lawyer.

1) May i hv the contact no. of A&S DB. I tried to search from Mr. Google but i cant find sth relevant..
2) The risk in my mind is: They may try to delay even more if i terminate them. Apparently she is helping the Vendor to drag (as the Vendor is still looking for a hse), will it fasten the process if i engage another lawyer? (by issuing letter to request for the docs required instead of let the currect SPA lawyer do watever she likes at her convenience)
3) Do u think they hv failed to perform as they don even answer my questions??
4) Can Bar Council really helps?

I try not to terminate their service but things are just not running at the standard speed. I m not asking for sth ridiculous, am i?

I tried not to terminate them by sending them another email to answer my questions within 7 days but they just keep ignoring me.

I called to the Bar Council to seek for help. They advised me to lodge a complaint against them.

I am very surprised the SPA lawyer would spoil their name for the sake of helping the Vendor'. shakehead.gif

Unfortunately after few months, the unit has not been handed to me yet.

And now new problems arise.

1) My SPA lawyer (which is also the owner's lawyer) sent me an email today morning to tell me that 1st MOT (between Developer & the owner) has been duly adjudicated dated 7 Nov 2011. Second MOT (between the owner and myself) was duly adjudicated on 29 Nov 2011.

2) Unfortunately the lawyer called me in the evening today to tell me that the owner has decided to pull out (after so long). They don't not want to sell the unit now. Reason given: There was an MIS-understanding between the husband & the wife. Wife wanted to sell but her husband never agreed to sell. Lol.. shakehead.gif

Now my questions are:

1) May i know what are my rights eventhough the owner is willing to pay back my 10% deposit + 10% compensation?
2) Is the owner supposed to bear for my SPA & Loan Lawyers' fees? I hv paid a few thousands to both my lawyers. cry.gif Can i ask them to pay?
3) What if i reject their request? (I noticed that the value of the property has increased more than at least 60k from my purchase price, i suspect this could be the real reason behind hmm.gif )
4) Shall i bring this case to court?

Dear Mr. Foo,

The Non-Completion By The Vendor(s) clause in my SPA as follows:

"In the event that the Vendor(s) shall fail neglect and/or refuse to sell and/or transfer the said Property to the Purchaser(s) in accordance with the provisions of this Agreement and/or be in breach of any of the provisions of this Agreement then the Purchaser(s) shall be entitled:-

a) to the remedy of specify performance against the Vendor(s) and to all reliefs flowing therefrom and the Vendor(s) shall be liable for all costs and expenses arising therefrom; or

b) the Purchaser(s) may terminate this Agreement by a written notice to such effect to the Vendor(s) whereupon the Vendor(s) shall refund to the Purchaser all moneys (including the Deposit) free from interest as shall have been paid to the Vendor(s) under this Agreement and pay a further agreed liquidated damages for the amount of XXX only within fourteen (14) days from the date of such notice of termination failing which interest at the rate of eight per centum (8%) per annum calculated on a daily basis shall accrue thereon from the day immediately following the expiry of the aforesaid fourteen (14) day period until full payment thereof thereafter this Agreement shall be null and void and neither party hereto shall have any claim against the other save for antecedent breach.

Do you think i have solid ground to ask for compensation for SPA lawyer's fee, bank penalty as well as LOAN Agreement Lawyer's fee?

It is not fair to buyer if the Vendor pulls out simply bcoz the Vendor can get better offer after dragging for so long... sad cry.gif
