greetiiinggsss....

hmmm... the story is... around 8 years ago... my wife and I decided to buy a home... we found a place within our budget and bought the place... we put our names as joint owner of the house and also joint account holder of the loan...

but last year we decided to divorce... now she moved back to her hometown and I moved to my parents house... I want to give the house to her since I dont want the place anymore... very hard to maintain since I dont live there anymore... and since she like the place so much I think better for her to take the house...

so question is... can I remove my name from the loan and house without her needing to apply for a new loan and all? if not any other way to solve this? I dont want money or anything... just want to give the the place and clear my name from the loan and house...

thanks guys! icon_rolleyes.gif

to remove your name from the house, i think you will need the help of a lawyer, the cost will depend on the price of your property

You need to "assign" the house to her via deed of assignment/gift.
Then with that she needs to re-finance (renew the loan).
This is my understanding, don't think you could "remove" name from loan just like that...

Hardly possible.
Removing the name is not as easy as taking the liquid paper and liquid it away.
There are loan agreements etc, and not all bank like 3rd party loan (where the house name is under 2 pax, but loan under 1)

So as mentioned before, transfer the house name to her, get a new loan = 100% possible

But ultimately, to get the answer u want, call ur bank and ask

Definately there is a loan agreement involving and going through the government to remove your name.Refinancing the property is the best way.

Blackrage, you can call me for further question as I am working in a law firm and do hope to get your case. 016-2325577 (cj) biggrin.gif
