HTC has just released the source code of Legend, Desire, Eris and Incredible.

Not sure how far does the source code goes.. but sound like a good news to me..

They are obligated to release the kernel source code or otherwise they'll be violating the GPL.

HTC is obliged to release the source if they modified the GPL codes, but they are not obliged to release the source of their drivers. By posting the source code of the kernels specific to each device, I assume they have kernel modules containing drivers together in the source code.. that's what I think, but do correct me if I'm wrong. =)
