what can i do if the previous owner don't want to leave?

i think ts means.. owner still owes bank a lot.. then bank take back the house and auction it out... when successfully auction jor... owner still have the key and go inside the auctioned house....

this scenario is very common as for auction case :S

yup..that 'ex' owner dunwan to leave..we already gave him around 5months time,but he still giving alot excuse and ask us to pity him...so, now im seeking advise on ways to 'chase' him out legally...any1 can help??

You would have to report to the police. That's the only way I can think off since you've already tried the "gentle method".

2moro will give the lawyer a call about it..wanna ask need to ask court warrant or just make a police report den i can go in the house...

i heard only can chase them out after the bank realease full payment to the assignor bank. correct me if i'm wrong. smile.gif

Why you buy the house in the first place? Should have check out the situation before auction. Only the lawyer can help you out now

where's location of the house? You can cut electric and water supply, the sooner the better, they will soon move out, please update the progress of this issue

Yup,
Cut electric and water supply is the best solution since we can't live in a house without it but lease make sure all the bills are already transferred to your name

Auction property doesn't include delivery of vacant possession.

There're 2 solutions, the soft method & the hard method.

Soft method = Pay the fella some money if he agrees to leave.
Hard method = From cutting off water & electricity supply to applying eviction order from court, lodge police report, request police assistance (when clearing the fella & him family out).

However, problems are more complicated if the fella is eligible to join MIC.

the bank had already release the whole payment to that 'ex' owner's bank.and start from this month we start to pay the installment.

the electric n water bill is already under my dad name since end of dec2009(once we get/won that auction)..and my dad is ok for paying the electric n water bill for them for these few months(dec09-apr10)..


Added on April 19, 2010, 8:38 pm***that house is under auction on mid dec09.one week after the auction we actually go to that house and tell that owner that we are the buyer and we would like to nego with them if they can move out on jan10 and we will pay 'some' money to them as compensate them to get out earlier and for their new house rental.
Whats going on is...this 'ex' owner asking us to sell back that house to him...(i dono what the heck is he talking that time??!!no money to pay loan still nego with us say wanna buy it back from us..).
My dad say 'impossible' to him. Then the 'ex' owner ask us to wait until the bank make the full payment to his loan bank(approval of loan) den he will move.
So on the early april10,the bank sent us a letter confirm with us that the loan is approved and we will need to start pay the installment from this month.So,the next day my dad went to that house and informed the 'ex' owner about it and give him 1week time to leave the house. (1week time may be short but pls rmb early on the dec09 we already informed him).But he say its too short,so my dad just giving him until 20th april 2010 and told him that on 20th april if he stil not leaving,we gonna demolish the house.
Ok..2moro is 20th of april.But from what we 'inspect' he din even move a single stuff from the house.(we stay nearby that house).

That's the story.

my dad called the lawyer today.and the lawyer say go make a police report and bring together with a 'politic' ppl or ketua kampung to that house and masuk. unsure.gif unsure.gif

Dad met with that 'ex' owner and his son on tuesday nite. no result. Giving excuse that the bank din inform them. den ask my dad wait till 1st of may. 1st of may is public holiday~sure got another excuse and story.
