Omg.that Skyline AGD 8 owner was rude.I was driving at Bukit Bintang at night.traffic jam that night.He then use the right lane(the opposite lane and potong my car). I gave it a loud horn that night.

and his car is rather fugly....always c him around sunway area...

Haha I love how that hihi said there's no need to say it's the wira's fault, yet he contradicted that by saying it is his fault.

Exactly, the law is black and white here. You rear-end, you pay. There's no point diggin garound the grey areas, the cops will only see one conclusion.

Now, the Wira does have to pay the RM300 saman, and the rest is claimed by the Ferrari's insurance off the Wira's insurance, ODKFK. The problem arises if the Wira's insured amount does not cover the repairs, and if the Ferrari does not have an underinsured coverage clause. Someone has to make up the difference, and that would be the unfortunate Wira driver.

I checked with my agent, cos I recently did get hit by a car with a lower insured value.
Apparently, both comprehensive and third-party insurance will cover the complete repair bill and loss of use to the car you hit based on legal liability and subject to the adjuster's reccomendation. The comprehensive will cover the car at fault until the insured amount, but the third-party will not at all. So the Wira owner will not have to come out from pocket except for the increased premiums and/or loss of NCB, and in the case of a third-party coverage, his own damage. That is what I was told, and hopefully that' the correct information.
