 what happen if Seller decided cancel SPA

dear senior,

pls advise:
if both buyer and seller already sign SPA.
but seller decided not to sell due to the value of the property up already?

btw, i'm the buyer.

Read the clause, maybe you need to pay a certain penalty.

the seller definitely has to return the deposits (not sure if there is interest to it), but check on the agreement

Signed already how to terminate the sales....Moreover, the lawyer represent the buyer.

if you get double, then, start looking for a new target...maybe that unit is not meant for you....

Can you recover the legal fee you have paid?

The seller will need to bear agent fee.....

Interested to know location of the property? Did it increase so much in short time that seller willing to pay double ????

Probably another buyer came & offered the seller a higher amount.

In the event a sale of property is terminated due to either side's intention. Buyer lose the 10% deposit while seller need to return the received deposit + another 10% of the selling price as penalty.

do you think it's cheap for a 1623psf at RM190k?
15th floor of Pandan Villa Condo that developer is TALAM

entrance door facing south.
2 balcony, one facing to North at living room and another facing to West at Master Room.
that's another block at the west side so no sunset problem.

SPA already send for stamping? Normal case the seller hv to return the full money and penalties to you due to cancellation. Did you appoint any sales Agent? If yes try to read the letter offer during you paid the deposit to the seller usually prepare by the sales agent. Sometimes there will be clause writen like "any one who cancel the sales should be return full amout and with penaties" (something like that).
