 HELP! CAR ACCIDENT, the guy never answer my call

I just involved in a minor car accident last week,

here the situation :

night 9pm,

a wira from left lane cut into my lane n bang my car, my front bumper paint dropped n he agreed to repaint the whole bumper

for me, he told me to ring him the following day morning so that he could bring me to the workshop he trusted for repair, since

then he never answer my call until today, already 1 week.

who experienced this before pls help me, what should i do next? report police, i don think its necessary bcz respraying the front bumper wont cost much.

you can report police in 24 hours time, if not you will have saman also.. that is what i know..

Just report police and never trust people in situation like this.

Police report is everything.So if he does not wanna pay you,go rape his insurance company instead and let him lose his NCB

Your best choice right now is to make a police report.
You should not trust that guy in the first place.

Unless u got jalan with the Sarjan at the police station, for me, I rather take the summons that the police will charge and go spray the bumper. Also, it's already been 1 week..who knows the guy may have already repaired his car's damage. Nothing you can do then! tongue.gif

If cannot settle there and then, best case scenario is to report police within the same day. If not, the person in wrong can only thank u~ whistling.gif

it really amaze me how people can actually wait more than a week. Normally if i don't hear within 12 hours, i'd just make a police report.

wadahell with if over 24hours or over 1 week no report the victim will kena summon? do u experience such thing urself? if not do u think this is logical? this is ridiculus!

Report can only be made after 24hours since the happening..correct if i am wrong, but that's what i know all the time. nod.gif

Please refer to Section 52(2) of the Road Transport Act 1987 (Act 333):

(2) In the case of any such accident as aforesaid the driver of such motor vehicle and, if there is more than one motor vehicle, the driver of each such motor vehicle, shall report the accident at the nearest police station as soon as reasonably practicable and in any case within twenty-four hours of such occurrence, and shall produce to the officer in charge of such police station his driving licence and if so required the certificate of insurance issued under section 90 of this Act.

Section 52(2) of this act shall then be read together with Section 52(5) of the same act which states that:
If any person fails to comply with this section he shall be guilty of an offence

So now you know it's not ridiculous. Likewise in Law, there is this maxim "Delay defeat Equity" - one should not sleep on his rights and procrastinate.

From what I heard:
Normal case, report within 24 hours.
Some cases, 48 hours still ok... with strong explanation.
If more than that, you will be fined $$$ on top of the accident summon compound.

So, if my hear-say is correct, if your bumper won't cost more rm500, you better go paint shop respray and donate the extra money and treat some frens a good meal "broke money get rid of bad omen"

But... if the guy reported to police before you report... you will be in trouble and vice versa

If you ever get involve into an accident, better solve the problem on the spot, do not delay them or you are the one that will get into trouble especially after the 24 hour period.

Haha yeah, actually you may report anytime even more than a week, but after 24 hours, you will be fined as you've committed an offence for reporting late. No one's going to prevent you from making a police report. Minikar is right, if your bumper won't cost a lot, better that you go repair yourself since you'll gonna be paying a fine anw. Also, reporting late is very delicate situation. Hard to prove anything since too long.

my advice.
call anywork shop, ask for repair cost.. ask the money on the spot... if he/she said no money to pay, go nearest atm with him/her, withdraw money.

if u just got hp number, no ic... much problem later.

nothing much u can do. just go to the workshop and repair the damage. if less than rm400 (correct me if im wrong) cant claim insurance. the best thing to do is id u have frens working with digi or JPN, ask them to help u track the address. or else, spend your hard earn money to repair the damage and cry. now i think the culprit alrdy laughing at home because he had saved his own ass.

a lesson learned.

some opt for u

1. go report police. he will be blacklisted for not reporting the case. but u have to pay saman also. maybe can cover using ur own insurance and lost NCB

2. find any trustable insurance agent. they have their own way to solve this. but u still need to pay some la.

happened to me once last year when my car was bang by someone. So he said that he will settle this and ask me to call him the next day cos he said he is rushing to hospital bla bla. So I let him go by taking down his IC , address and so on. I tried to call the next day, no answer until 5 days. Then i no tahan already, straight go to his house. Met his mom, and the mother said, the boy didnt come home since the last 5 days. Lari rumah liao.

Then the mother agree to pay on behalf of his son.

Already one week? Actually if you wan to claim insurance then need to lodge a police report within 24 hours of a road accident.

But you still can try though, make police report to track that person down

After 24 hours no report, don't care you're victim or not, wrong or not, you will get summon for reporting late. Then police will work with JPJ to blacklist the other guy who bang you since he disappeared & no report, but I can assure there is no warrant to capture that guy nor you can claim any insurance from that guy because there is no police report from his side.

it whether u want to make him suffer, but with price. you need to

1. pay your own repair + bruise pride.. or
2. pay summon + lost ncb discount (55% of your yearly insurance) + hassle to go traffic police station+still may have to pay ur own repair

your choice and your own fault btw.
