CF question

Recently, i just get my house key but the developer told me that CF is not ready yet and we have to wait for it before we start renovation. I'm 1st time house buyer therefore i'm a bit confused about:-
1. Wasn't the CF is approved only we can get the house key? 2. How long it take for CF approval as it almost 1 month since i get the key and VP. 3. The developer told me that CF is delayed because DBKL don't have any meeting this month; is it need to wait for DBKL meeting only can get the CF. 4. What can i do against the developer if they continue to delay the CF. 5. I had pay the TNB meter deposit but until now i haven't get the TNB meter (delay 1 month), what can i do?
Please help me as i'm quite frustated now because we want to move in before the Hungry Ghost festival coming in August.

The requirement of CFO has been revised to CCC (Certificate of Completion of Construction) which is issued by architect. Did you receive copy of CCC together with your Vacant possession(VP) letter?
In any case, the standard SPA does not specify issuance of CFO as requirement for handing over of VP.

The developer's scope is to get ready the house with the water and electricity ready for connection. Now they passed the "balls" to the authority (DBKL,TNB & Syabas) . So, what can u do now is to complain to the relevant authorities.

Yes, I did receive the CCC together with the VP. Is that mean i don't need to wait for CFO and can start my renovation now?
Can i call DBKL to check the condo CF status?

1. No, the developers can hand out the keys when VP is delivered. Meaning the house is duly completed and waiting for the authorities (in this case, DBKL) to process the Form E served by the developer for the CFO cert.
2. Yes, usually it would take about a month, give and take.
3. Might be, but you can always check whether the developers have submitted or not the Form E to the DBKL. Sometimes the delay is caused by developers themselves due too some of the documents they submitted to DBKL is not complete.
4. None, if it is confirmed that developers have already submitted the complete Form E to the DBKL. It's DBKL fault that the CF is delayed, not the fault of the developers. You might want to check with them, DBKL I mean, if this is the case.
5. Did you pay the deposit for the water and electricity connection to the developer or to the said authorities themselves? If you paid the deposit to the developer, you might want to check with the TNB whether the developer has already paid them the deposit. If not, write a letter to urge the developer to hastened the process. Keep a copy to yourself too.
You seriously need to wait for the CFO cert before you do any renovations.
