I just settled my court case with them this morning. Got a portion of my money back.
Oh!! That guy was a bloody A-hole!! Called me last night asking whether I want to settle it outside of court, when I refuse, he threaten "You will sure lose I tell you now, I have all the evidence here. If you go to court I won't give you back a single cent". I just won the case, IN HIS F*ING FACE!

I'm not gonna care, I'm gonna defame them here.

They are only trying to scare you when they say you won't get a cent back. Because it is up to the judge whether or not you get the money back. Could be full, could be 50%.

On that day, they claim I sign at my own will also. I said, I signed it knowing that I might get the Jade Mattress, but I didn't know it was a scam. I told the judge that, if this mattress was part of a scam, it doesn't matter if the market price is RM10000, I still can't sell it.

In the end, the judge gave orders that I return them the mattress, and they refund me RM1100, instead of RM1200 which I lost.

How are you being scammed? Did they tell you that you've won the 4 products? Or did they sell you the products for RM4k?

Even if you don't have any receipt, you better hope Starr Healthcare has the copy of your signature on the contract. So that is a proof of purchase. You can probably argue that they didn't send the products as they promised.

If you were scammed that you've won, what I told the court was that I signed the documents because I thought I am able to sell the product. But because the product is below the standard that they proclaim they are - ("Very Good Japanese Brand - Kochima"), so I am not able to sell and want a refund. I told the judge "it is similar to trying to sell a stolen car".

Haha... Awesome! I wish I get to see someone do that!

PSS. When they called me to get my money, they seemed happy. Like weirdly happy... Wonder if because they have just ripped off some poor fellow...

I wonder, this Starr Healthcare scam most surely is run by kongsi gelap adi. Then if you bring some kongsi gelap fellow go beat them up, what if when they see them, notice they are same gang? Then what happen? Still beat them up? Or they refund you because you are same "family"?

I hear from a personnel at the tribunal saying that they have several branches of operation in Klang Valley. Since you chop at Kuchai Lama, so go back there to collect from them lo. If you have the receipt, maybe you can call the person that conned you (if he wrote his number on the receipt).

Er... Maybe can gua. I'm not the judge, and not a lawyer... that day was the 1st time I attend court oso.
I guess its a viable point. Saying that after checking online then only you know the company has bad reputation, and you regret buying from them. Since you didn't receive any products yet, you want a full refund.

But I think the chances of winning is not high, because you bought the stuff. Unless after using then you know is bad product (i.e. spoiled after a week) then maybe you can ask for refund. But without using it yet, there is no issue to argue.

Er.. I really can't think of any points to fight wor... Maybe some other forummers here may be able to help you.

I'm quite sure if you tell the tribunal they will issue another copy for you. With the new dates as well. Since its not your fault that the letter didn't make it to them in time. I sent my letter to them by mail oso. But it got there in time la i guess. Note also that it says 14 working days, not 14 days ... so it might be 3 weeks...

BTW, I sent the photocopy version. The person at the tribunal told me that the original copy is for you to keep. If you send it to them, they might claim that they didn't receive anything. So you have to keep the original and send the copied version just for safety sake.

Don't believe their shit... They only scaring you so that you might negotiate with them and settle out of court for half the money. With so many cases, I think the judge should have already know who is the good guys and who is the bad...

For the rest of you who didn't get scammed, you should be at least sympathetic. Just because you are "smart" enough to notice the scam, doesn't mean others are as lucky. No one ever wanted this to happen.

If I were to blame, I blame the government for not issuing a warrant to clear them up despite the many court cases that happened. (Maybe the judge too boring, need more court case)

Don't worry, if you have the award letter with you, they must follow the letter. Or else action can be taken against them. And I think they will give you the money straight away without negotiating. (They must be earning more than they are paying back)

I've also seen a couple of them near Pudu Raya Bus Terminal. They are standing outside the Nando's retaurant near the junction turning into Jln Sultan...

ykdoro: Yes, I know its a hassle to keep going to the tribunal to make the report. Must wait few months some more. Anyway, congratz on getting back your money. Mind telling us what is the new company name they put up?? Is it the one sawmania is referring to?

sawmania: I heard the personnels at the tribunal say that they have 2 operating offices. One is in Kuchai Lama, the other in Desa Danau. Probably the same, just changed name.

I didn't make a police report when i filled my report at the tribunal. They paid me back the money after losing the court case. I bet there are many more people that reported to the police, but I don't see the company close down, so I think its redundant to turn to the lazy cops.
