I just paid my lawyer in full for the stamping fee. He say that need to pay in full first and then the 50% will be returned later from the stamp office. Say that he has submitted a lot of cases for the 50% refund but received no reply from the stamping office. Can someone confirmed if this is true? Thanks.

Harap maklum pengecualian duti setem diberi sebanyak 50 % kepada setiap individu ke atas pembelian rumah kediaman yang berharga tidak melebihi RM 250000.00 yang diumumkan dalam Bajet 2008 telah berkuatkuasa serta-merta (mulai sekarang) di LHDNM walaupun warta belum dikeluarkan oleh Menteri Kewangan.
Untuk sebarang pertanyaan yang selanjutnya sila hubungi mana-mana cawangan LHDNM (Unit Duti Setem) yang berhampiran.

lets hope that we dont have to pay 100% first.
so far my lawyer havent come back to me on the total cost of the stamp duty. pray hard its the discounted one

mine havent collect yet, they just collect their lawyer fees first, they say will collect the stamp duty after gov return with the amount.

The lawyer who handled buying/selling house that I contacted said this "Offer" only valid untill 2010 and for one house only during that period.

You need to pay 50% only upon assessment done by land office. You need not have to pay lump sum or full amount if you know how to talk to lawyer.
You have option also to choose another lawyer if you do not like the one assigned to you.
You can choose to get loan from another bank too.
You have the right with you.

as what i know, the 50% refund of stamp duty for <250k, it subject to stamping office, although they have a guide line, but not 100% entitle, so normally lawyer will charge u 100% first, in case u are not entitle for this.
i have one customer jz looking for best price, and some lawyer quote very cheap fee, dint quote 50% of that stamp duty only, to attract him assign them, when he is not entitle for this, do u think lawyer wont charge him back meh ? i told him b4 but he insist want to choose tht lawyer.. so i jz prepare to watch movie looh.
your lawyer is responsible and pro, not like those lawyer who want to get more sale, jz quote as low as possible, when everything done, only say have to charge another fee, blah blah blah...

hahaha..my lawyer didnt charge me yet on the stamp duty cos waiting reply from IRB...
I just received my letter from lawyer 2 days ago..& been ask to pay 50% stamp duty as approval been given by IRB

i buying 240k my 1st property now..i ask my lawyer,they say they will submit to LDHM for me..not guaranty can get..depent LDHM approved or not..izzt true??

it is guaranteed, as long as its your 1st property for which you are applying for the discount. each person only gets the discount once. only problem is LHDN sometimes makes a mistake and charges the full one, and then its up to your lawyer to appeal.

if it will affect the time frame for the money to be handed over to the seller, you might want to pay first. last time when i bought, i didnt want to pay up front the whole amount, wanted to wait for the apeal, took about 2 weeks before it was approved

i guess in this situation your lawyer is worried that you have claimed the half stamp duty before, and as such will not be eligible this time. and since he has to confirm with your loan lawyer that you have paid the stamp duty, he wants to protect himself 1st.
but i think most lawyers will just trust their clients over something small like this. some more you have signed a statutory declaration saying this is your 1st time claiming.

half stamp duty is only applicable for MOT. for s&p, the stamp duty is only rm10 per copy... half wont save you much.

residential = house, condominium unit, apartment or flat built as a dwelling house.

That's good then. I just wanted to be sure.... I have so much trouble looking for loans because the unit i am buying is a serviced apartment. It's like a totally different type of property.

Is for MOT, pay to LHDN. It will cost u around 2k plus if no 50% discount.
